EXECUTIVE SUMMARY
Recommendation to direct staff to bring back an amendment to Collier County
Ordinance No. 97-82, as amended, the Bayshore Avalon Beautification Municipal
Service Taxing Unit, removing all references to the word "Avalon" from the title of
the MSTU and throughout the Ordinance.
OBJECTIVE: That the Board of County Commissioners direct staff to bring back an
amendment to Collier County Ordinance No. 97-82, as amended, the Bayshore Avalon
Beautification Municipal Service Taxing Unit, removing all references to the word
"Avalon" from the title of the MSTU and throughout the Ordinance.
CONSIDERATIONS: Pursuant to the Board's prior direction, staff is bringing back a
proposed amendment to Ordinance No. 97-82, as amended, to increase the membership
on the MSTU's Advisory Committee from five (5) to seven (7) members. The Advisory
Committee also seeks to amend the title of its MSTU and to all references throughout the
Ordinance by deleting the word "Avalon" therefrom. Removal of the reference to the
word "Avalon" is appropriate because neither Lake Avalon nor any other geographical
reference using that title is known to exist within the boundaries of the MSTU.

Staff seeks the Board's approval to bring back the amendment to the title of the ordinance
at the same time it brings back an amended ordinance to reflect an increase in the
membership of the Advisory Committee. By approving this request, the county will
promote administrative cost-savings by advcrtising only one amendment to the ordinance
rather than two separate anlendments,
FISCAL IMPACT: There is no fiscal impact associated with this matter.
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this matter.
LEGAL CONSIDERATIONS: There are no direct legal considerations to address.
RECOMMENDATION: To direct staff to prepare an amending ordinance amending
Collier County Ordinance No. 97-82, as amended, the Bayshore Avalon Beautification
Municipal Service Taxing Unit, removing all references to the word "Avalon" from the
title of the MSTU and throughout the Ordinance.

Summary of Motions
V. Landscape Maintenance Report - Gronnd Zero
Aaron Gross suggested Landscape repair along Bayshore now that
Construction is complete. Estimated cost $3,500.
Maurice Gutierrez moved to approve the necessary Funds to do those
corrections (Landscape repairs.) Second by Conrad Willkomm. Motion
carried unanimously 5-0.
David Jackson reviewed letters from the Fire Department Chief and the
Deputy Chief requesting that the Hedges be trimmed to clear the Line of
Sight for the Fire Departments SUV.
Thomas Finn moved to approve the trimming of the hedge by the Fire
House as per David Jackson's memo. Second by Maurice GutierreZ',
Motion carried unanimously 5-0.
David Jackson reviewed the Draft Scope of Work for the South Bayshore
Project. He requested approval of the 50/50 agreement between the CRA
and the MSTU for the Initial Scope of Work in the amount of $55,943.64
(off County Contract #04750.)
Conrad Willkomm moved to split cost with CRA not to exceed
$30,000.00. Second by Maurice Gutierrez. Motion carried unanimously
5-0.
Tessie Sillery announced the MSTU title is recorded as "Bayshore
Avalon" in the Ordinance. She questioned Committee preference for the
MSTU title in the Ordinance. Discussions ensued.
Maurice Gutierrez moved to change the MSTU from Bayshore Avalon
to reflect Bayshore (Beautification.) Second by Conrad Willkomm.
Motion carried unanimously 5-0.
VI. Transportation Services Report
A. 1 Budget Approval - FY09 Budget was distributed and reviewed.
