RECOMMENDATION TO DECLARE A VACANCY ON THE HABITAT CONSERVATION
PLAN AD HOC COMMITTEE
OBJECTIVE: To declare a vacancy on the Habitat Conservation plan Ad Hoc Committee and to
direct staff to issue a press release soliciting resumes in an effOli to fill the vacant position.
CONSIDERATIONS: Ordinance No. 2001-55, Section 8, reads as follows: "It is the intent and
strong desire of the Commission that there be full attendance of advisory Board members at all
meetings of the Boards, recognizing, however, that it may be necessary for Board members to be
absent from a meeting due to unusual or emergency circumstances. Nevertheless, full attendance at
Board meetings is encouraged and necessary for the proper operation of the Boards and in
furtherance thereof the following requirements are established: A. Any Board member who is absent
for more than one-half of the Board's meetings in a given fiscal ycar shall be deemed to have
tendered his or her resignation for such Board. The Commission shall, as soon as practicable after
such resignation, declare the position to be vacant and shall promptly fill same pursuant to the
provisions of Section Six herein. The Board member shall not serve at any meetings after his or her
position is declared vacant by the Commission. B. In the event that any Board member is absent
from two consecutive Board meetings without a satisfactory excuse acceptable to the Board
chairman, the Board chairman shall state such fact at the next regularly scheduled Board meeting and
shall thereafter notifY, in writing, the Executive Manager to the Commission of the Board member's
failure to attend without satisfactory excuse. The Commission shall review the Board Chairman's
notification at a Commission meeting and shall declare the Board member's position to be vacant if
the Commission concurs that the Board member was absent from two consecutive Board meetings
without a satisfactory excuse and shall promptly fill same pursuant to the provisions of Section Six
herein. The Board member shall not serve at any meetings after his or her position is declared
vacant. C. A member of a Board shall be deemed absent from a meeting when he or she is not
present during at least 75% of the meetings.
Attached is an e-mail dated April 30, 2008 from the Chairman of the committee requesting that the
Board of County Commissioners declare a vacancy on the committee and direct staff to advertise to
fill the vacancy as follows:
Christian Spilker - Absent with a satisfactory excuse for 10 out of 19 meetings in 2007
Absent from 3 meetings in 2008 - unexcused
FISCAL IMPACT: NONE
GROWTH MANAGEMENT IMPACT: NONE
RECOMMENDATION: That the Board of County Commissioners consider the recommendation to
declare a vacancy on the Habitat Conservation Plan Ad Hoc Committee and direct staff to issue a
press release soliciting new members. It is also recommended that the Board of County
Commissioners direct the County Attorney to prepare a resolution declaring the position vacant.

As chair of the HCPAC, I request that the position on our committee occupied by Christian Spilker be declared vacant by the
Board of County Commissioners as prescribed by Collier County Ordinance No. 2001-55, as amended or its successor
ordinance. He was absent without a satisfactory excuse for 10 out of 19 meetings in 2007 (at three of these we did not have a
quorum due to his absence) and excused from three more. He has been absent from all [3J of the meetings in 2008 without a
satisfactory excuse. After the BCC's action, please proceed to advertise his position.

This committee was created on March 22, 2005, by Resolution No. 2005-174 and amended on
February 14, 12006 by Resolution No. 2006-41 to expand membership to 13 members. They wiil
serve as a forum for community review and discussion regarding Habitat Conservation Plans
(HCP). The committee is specifically tasked to evaluate the geographical scope (excluding the
Rural Lands Stewardship Area) and coverage of an HCP including the species associated with
the geographical scope, to identify the types of impacting activities including County infrastructure
needs, to identify the financial impacts of an HCP, to assess the community support for an HCP,
and to identify alternatives to an HCP, if an HCP is not deemed feasible, The committee will
ultimately provide its findings and recommendations to the Board of County Commissioners.
Terms are 3 years.
BCC adopted Reso No. 2006-41 extending terms to 3 years after the appointment of 3 additional
members (September 12, 2009)
