Agenda 05/27/2008 Item #16J 4 Agenda Item No. 16J4 May 27, 2008 Page 1 of 2 EXECUTIVE SUMMARY Recommendation to approve budget amendments recognizing carryforward in Teen Court Fund (171) and transferring funds to Court Innovations Fund (192) in accordance with Ordinance 2004-42 in the amount of $123,900. OBJECTIVE: To obtain Board of County Commissioners approval of a budget amendment which recognizes carry forward in the Teen Court Fund (171) and transfers those funds to the Court Innovations Fund (192) in accordance with Ordinance 2004-42. CONSIDERATIONS: The Board of County Commissioners established Ordinance 2004-42 providing for the imposition of a $65 surcharge on certain criminal cases, This ordinance was adopted pursuant to the implementation of Article V in the State Constitution, The Ordinance provides an a11ocation formula of the surcharge to various court related funds. Ordinance 2004-42 provides that any unspent funds at the end of each fiscal year shall be transferred to the Court Innovations Fund (192), .'-" When this Ordinance was adopted, the Teen Court Fund (171) contained residual carry forward funds, $93,200 of the residual carry forward has not been appropriated. Since the adoption of the Ordinance, appropriated carry forward in the Teen Court Fund (171) has increased by $30,700 brittging the total amount available for transfer to the Court Innovations Fund (192) to $123,900. The $30,700 carry forward discussed above is currently appropriated in the Teen Court Fund (171) reserves, A budget amendment is necessary to: I. Recognize previously un-recognized Garry forward in the amount of $93,200; 2, Decrease reserves by $30,700; and 3. Transfer these funds ($123,900) to the Court Innovations Fund (192), FISCAL IMPACT: These funds are derived from a $65 surcharge on certain criminal cases. There is no affect to the General Fund (001) and the Court Innovations Fund (192) depends on these transfers to help meet their financial obligations, GROWTH MANAGEMENT IMPACT: There is ttO growth management impact associated with this request. RECOMMENDATION: That the Board approves budget amendments recognizing carry forward and decreasing reserves in the Teen Court Fund (171) and transferring these funds to Court Innovations Fund (192).
