Agenda 05/27/2008 Item #16E 6 Agenda Item No. 16E6 May 27, 2008 Page 1 of 14 EXECUTIVE SUMMARY Recommendation to approve an Agreement for Sale and Purchase with Kaye Homes, Inc., a Florida corporation for 4.00 acres under the Conservation Collier Land Acquisition Program, at a cost not to exceed $340,700. OBJECTIVE: To obtain approval from the Board of County Commissioners for execution of the attached Agreement for Sale and Purchase (Agreement) between the Board of County Commissioners (Board) and Kaye Homes, Inc., a Florida corporation (Seller). CONSIDERATIONS: On January 29, 2008, Agenda Item 10F, the Board approved a Collier Conservation Land Acquisition Advisory Committee (CCLAAC) recommended Active Acquisition List, with changes, and directed staff to actively pursue acquisition of the properties under the Conservation Collier Program. The Seller's property consists of three parcels totaling 4.00 acres and is located adjacent to the existing Conservation Collier's Nancy Payton Preserve. In accordance with the approved Conservation Collier Purchasing Policy, the purchase price of $332,250 was based upon the average of two independent, state-certified general real estate appraisers. The attached Agreement provides that should the County elect not to close this transaction for any reason, except for default by the Seller, the County will pay the Seller $1 ,661.25 in liquidated damages. The CCLAAC approved this transaction on May 12, 2008, and voted to recommend Board approval and execution of the attached Agreement. Pursuant to Ordinance 2007-65, Section 13(8), a Project Design Report for the property is provided herewith. FISCAL IMPACT: The total cost of acquisition will not exceed $340,700 ($332,250 for the property, $6,200 for appraisals, and approximately $2,250 for the title commitment, tltie policy, and recording of documents). The funds will be withdrawn from the Conservation Collier Trust Fund (172). As of May 12, 2008, property costs for Conservation Collier properties, including this property and those under contract, total $63,565,516. GROWTH MANAGEMENT IMPACT: Fee simple acquisition of conservation lands is consistent with and supports Policy 1.3.1(e) in the Conservation and Coastal Management Element of the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: The Conservation Collier Ordinance (2007-65) provides a legal framework for property acquisition for the Conservation Collier Program. The process for acquiring this property falls within the legal framework of Ordinance 2007-65. The Agreement has been reviewed and approved by the County Attorney's Office. - JAB RECOMMENDATIONS: Staff is recommending that the Board of County Commissioners: 1) Approves the attached Agreement and accepts the Warranty Deed once it has been received and approved by the County Attorney's Office; 2) Authorizes the Chairman to execute the Agreement and any and all other County Attorney's Office approved documents related to this transaction; 3) Authorizes the County Manager or his designee to prepare related vouchers and Warrants for payment; and 4) Directs the County Manager or his designee to proceed to acquire this parcel, to follow all appropriate closing procedures, to record the deed and any and all necessary documents to obtain clear title to this parcel, and to take all reasonable steps necessary to ensure performance under the Agreement. It is an example of a good quality native pine flatwood plant community. Mapped soils on these parcels include (in order from largest to smallest area covered) Malabar Fine Sand - a hydric, slough soil, lmmokalee Fine Sand - a non-hydric soil and Holopaw Fine Sand, Limestone Subtratum - a hydric, slough soil. Typical vegetation for these soil types includes slash pine, cypress, cabbage palm and palmetto. The property contributes somewhat to the Lower Tamiami Aquifer Recharge (7"-14" annually) and significantly to the Surficial Aquifer (56"-67" annually). Public Utilities have indicated potential interest for easements for wells and water lines through some of these parcels; staff will work closely with them to accomplish a feasible goal. The Red-cockaded Woodpecker (Picoides borealis), a species that is listed as Endangered by the U.S. Fish and Wildlife Service and a Species of Special Concern by the Florida Fish and Wildlife Conservation Commission, prefers this habitat and has been detected by staff on the adjoining Nancy Payton Preserve. The observed habitat and location of the Kaye Homes properties would support the presence of the following listed species: Florida panther (Felis concolor coryi) , Florida black bear (Ursus americanus f/oridanus) and red-cockaded woodpecker. A radio-collared Florida panther and Florida black bear were located on adjacent properties within I mile of the adjoining preserve. Additionally, gopher tortoises (Gopherus polyphemus; a species of special concern) have been seen on the adjacent preserve. One (I) listed plant species was observed (Tillandsiafasciculata). The parcels contain fairly open areas and a high quality pine flatwoods that will require littlc to no restoration. Additionally, trails could be constructed with little clearing so visitors may access the open areas to enhance their experience. These parcels may be suited for the development of a small parking area if the proposed road along the north side of the Nancy Payton Preserve is not developed, however; use of Blue Sage Drive by the public would require pennission from property owners. Proiected Manal!ement Activities: Projected management activities will include removal of invasive exotic plants, management of vegetation to benefit the Red-cockaded Woodpeckers, potential development of a small (less than 20 spaces) public parking lot, and the development of an Americans with Disabilities Act (ADA) fully accessible trail and maintenance of existing trails for hiking. Management of these parcels would be combined with that of the Nancy Payton Preserve, providing economies of scale. 2 CONSERVATION COLLIER TAX IDENTIFICATION NUMBER: 61731040006. 61730960006 & 61731000004 Agenda Item No. 16E6 May 27, 2008 Page 5 of 14 Prepared by: Jennifer A.
