Agenda 05/27/2008 Item #16A10 Agenda Item No, 16A 10 May 27, 2008 Page 1 of 25 /'~ EXECUTIVE SUMMARY Recommendation to adopt a Resolution amending the Collier County Administrative Code Fee Schedule of development-related review and processing fees as provided for in The Code of Laws and Ordinances, Section 2-11 OBJECTIVE: To have the Board of County Commissioners (BCC) approve a resolution amending the Collier County Administrative Code Fee Schedule of development-related review and processing fees as provided for in The Code of Laws and Ordinances, Section 2-11. CONSIDERATION: In their review of the Community Development and Environmental Services (CDES) FY 2008 budget, the Collier County Productivity Committee recommended that CDES implement an optional additional charge for those customers requiring an expedited review of permit applications. Such an expedited building permit review fee is in place in other Floridajurisdictions, including Miami-Dade County. ~ Current CDES building permit fees are based on the costs for the level of staff resources required to exactly meet advertised review turnaround times, such as 30 days for commercial plan reviews. With the slowing number of applications in CDES, recent and ongoing staff reductions have been based on maintaining tins relationship between actual revenue and advertised review times. This proposed optional expedited building pernlit application review process will not affect normal turn-around times, and is intended to give applicants an alternative process to receive faster reviews. Optional expedited review fees will be used to contract with additional plan review resources, or with Building Review & Permitting Department staff to conduct reviews outside of normal business hours. The fee is based on our best estimates of actual costs, which is an approximate 50% premium over the normal costs incurred for the 60% of the building permit process which is associated with plan review and application processing (the other 40% of the process is associated with inspections). These costs will be carefully tracked, and tile optional expedited review fee will be adjusted if needed to insure it reflects the actual costs of providing this servIce. The guaranteed standard for optional expedited reviews will be completed in one-half, or less, of the normal advertised standards for the engaged type of building permit The commercial permit review of 30 days, cited earlier in this Executive Summary, would have to be completed in 15 days or less under an expedited review. If CDES fails to meet this shortened expedited review standard, all expedited review fees would be refunded to the applicant in full, and normal pennit fees would apply. Aoenda 11em ~Jo. 16A 1 0 -' May 27, 2008 Page 2 of 25 b, Review complction times are guaranteed to equal, or be less than, one-half of the normal advertised completion timeframes, Should the expedited review exceed this guaranteed completion time, the 30% optional expedited building permit review fee will be refunded to the applicant, and all nonnal permit fees will apply, Such guarantee and refund provisions shall apply to reviews, and do not infer or relate to approvals, c, Optional expedited building permit review fees shall be due at the time of building permit application submission, d, Any required re-submissions of permit applications leading to re-reviews, when due to applicant insufficiencies, shall be subject to additional optional expedited building permit plan review fees if an additional expedited review is requested by the applicant for the re-review, and shall be calculated against re- submission charges, Included with this Executive Summary are: Attachment "A"- the Resolution and Attachment "B"- the revised CDES Fee Schedule, Also included is the International Building Code Construction Valuation Table, the currently in effect February 2007 version, which is listed as an attachment to the Fee Schedule internally to that document In addition to the Productivity Committee recommendation, this proposed optional fee was reviewed by the Development Services Advisory Committee at their May 7, 2008 regular meeting, and was recommended for BCC approval by a 10-0 vote, FISCAL IMPACT: This Executive Summary does not require, nor request, any increase in the current allocation of CDES operating or personnel expenses already approved by the BCe, CDES has no basis for a reliable estimate of potential usage of this program at this time. As actual revenue and expenses are incurred, CDES will amend the budget as needed through the normal review and approval process, GROWTH MANAGEMENT IMPACT: There are no growth management impacts.
