EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners (BCe) waive the formal
competitive threshold and authorize Staff to use the Naples Daily News for all
required legal advertising expenditures. It is anticipated that The Zoning and Land
Development Review Department will exceed $50,000 per year.
OBJECTIVE:
To obtain approval for the expenditure of funds, if necessary, beyond the $50,000 dollar
limit contained in the Purchasing Policy for the required legal advertising placed in the
Naples Daily News.
CONSIDERATION:
To date, the Zoning and Land Development Review Department has spent $48,000 of the
$80,000 Legal Advertising budget for various legal notice and publication requirements
which appeared in the Naples Daily News. In the last two (2) fiscal years the Department
has exceeded the formal competitive threshold of $50,000 for the Naples Daily News.
For the Department to satisfy legal advertising invoices, recommendation is to have the
BCC approve expenditures above the $50,000 dollar Purchasing Policy threshold.
FISCAL IMPACT:
Funding has been budgeted for legal advertising in the Zoning and Land Development
Review Department Cost Center 131-138326, operating expenses.
GROWTH MANAGEMENT IMPACT:
This has no direct impact on the Growth Management Plan.
LEGAL CONSIDERATIONS:
No review from the County Attorney is required.
RECOMMENDATION:
That the Board of County Commissioners waive the formal competItIon for legal
advertisement in the Naples Daily News in order to satisfy the legal advertising requests
associated with proposed Ordinances, Resolutions. Conditional Use Petitions, Variance
Petitions, Planned Unit Development (PUD) Petitions, Rezoning Extension Petitions,
Neighborhood Infonnational Meetings, and the Historical Preservation Advisory Board.
