Collier County Board of County Commissioners, Against Paul Vescio in County Court
Small Claims in and for Collier County, Florida, to Recover Damages in the Amount of
$8,625.60.
OBJECTIVE: For the Board of County Commissioners to authorize the County Attorney
to file a lawsuit in the County Court in and for Collier County, Florida against Paul Vescio
to recover repair costs, damages, and administrative fees incurred by the County in the amount of
$8,625.60.
CONSIDERATIONS: On November 27, 2007 at approximately 8:24 P.M., Paul Vescio
was operating a County Vehicle while under the influence, and he struck another vehicle and a
carport, damaging both vehicles and the carport, The damages and repair costs to the County to
repair the County vehicle, the other vehicle and the carport totaled $8,625.60. Paul Vescio was
arrested and charged with numerous offenses, and his employment with the County was
terminated. Although contacted on numerous occasions, Paul Vescio has refused and continues
to refuse to pay for any of the County's damages and costs. The County has no other recourse
for recovery of the costs than to proceed with litigation,
FISCAL IMPACT: Funds are budgeted and available in the Risk Management Property &
Casualty Fund.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item.
LEGAL CONSIDERATIONS: Both the County Attorney and the Risk Management
Director opine that the County has no other recourse for recovery of the costs and damages
incurred, in the sum of $8,625.60, Approved: {'(if t f/Y) ACA
RECOMMENDATION: That the Board of County Commissioners authorize the County
Attorney to file a lawsuit against Paul Vescio in County Court in and for Collier County, Florida,
to recover $8,625,60 for costs incurred as a result of the damages to the County's vehicle, a
citizen's vehicle, and the carport, and costs of the suit.
