Recommendation that the Board of County Commissioners approve an exception to the current
hiring freeze policy for general fund positions and authorize the County Attorney to advertise for
and replace a newly-vacated essential Assistant County Attorney (Litigation) position.
OBJECTIVE:Recommendation that the Board of County Commissioners approves an exception to the
current hiring freeze policy for general fund positions and authorizes the County Attorney to advertise for
and fill a newly vacated Assistant County Attorney (Litigation) position.
CONSIDERATIONS:
The Office of the County Attorney currently has 13 budgeted positions for attorneys, including the County
Attorney, which includes a position that will be terminating in October. As previously stated, it has been my
opinion that this Office, over time, needs three experienced attorneys in order to improve the performance
of the Office. In order of importance, these positions are that of a land use attorney, a trial attorney, and a
contracts attorney (which position is most easily trained in-house). At its May 13, 2008 Meeting, the Board
approved an exception to the current hiring freeze for general fund positions allowing for the hiring of land
use attorney. After an extensive search, Mr. Steve Williams was hired for the position. Mr. Williams had
been a partner in a small law firm in Marathon, Florida, and a member of the City of Marathon Planning
Commission, specializing in representing developers in land use matters and litigation. Assistant County
Attorney Ellen Chadwell has recently resigned her position, creating an opening in the Litigation
department. I am asking the Board to approve an exception to the current hiring freeze in order to replace
this essential vacant position in a prompt manner.

FISCAL IMPACT:None. This is a replacement for a position which is currently budgeted in the
County Attorney budget.
GROWTH MANAGEMENT IMPACT:There is no growth management impact associated with
this Executive Summary.
