Dear Mr. Woodhouse:
Please be advised that you are scheduled to appear before the Collier County Board of
Commissioners at the meeting of September 9, 2008 regarding the above referenced
SUbject
Your petition to the Board of County Commissioners will be limited to ten minutes.
Please be advised that the Board will take no action on your petition at this meeting.
However, your petition may be placed on a future agenda for consideration at the
Board's discretion. If the subject matter is currently under litigation or is an on-going
Code Enforcement case, the Board will hear the item but will not discuss the item after it
has been presented. Therefore, your petition to the Board should be to advise them of
your concern and the need for action by the Board at a future meeting.
The meeting will begin at 9:00 a.m. in the Board's Chambers on the Third Floor of the W.
Harmon Tumer Building (Building OF") of the government complex. Please arrange to be
present at this meeting and to respond to inquiries by Board members.

The following is part of an e-mail that I sent to Mr. Joseph Schmitt about one
month ago.
"'n the last few months my daughter and I have completed and just opened a
"Tropical Smoothie Care" in the new Nortthbay Shops at US41& Wrggins Pass Rd.
During construction we applied for pennlts based on 42 seats. With this number
impact fees were calculated to be $15937.61). Upon the Installation of the booths
that we thought were for 6 people, we found that they used the same tables as
those for 4 people and there was not ample room for 6. With this in mind the total
seating is really 34 and not 42.
According to my daughter and the discussion she had with "Gilbert" in the Public
Utilities Office and "Amia" also in the same office this would change the fees by
aprox. $4000. They stated that they did not have the authority to make changes in
the fees and we would need to go higher up! ..
Mr. Schmitt refened me to Amy Patterson of the Impact FeelEconomic
Development Manager who in turn referred me back Amla Curry of the Public
Utilities Division who in tum referred it to the County Attomey. All of the above
people said they had no authority to make any changes in the fees already paid
and the only authority beyond them is the County Commission8f'll,

As a taxpayer, county citizen, new business owner, employer, and voter I am
aaking the commisslon to consider our request for a refund of the overpayment of
our Impact Fees. This money is important to us as new business owners as the
fees were much more than antieipBted and caused some problems with us getting
started.
