Agenda 06/24/2008 Item #17E Agenda Item No, HE June 24, 2008 Page 1 of 70 EXECUTIVE SUMMARY CUE-2008-AR-13066, Dieudonne Brutus, of the Tabernacle of Bethlehem, represented by David Sneed, Kuhlman Engineering, Inc" is requesting a one-year extension of a Conditional Use approval for a church granted in Resolution No, 05-134 in the Village Residential (VR) Zoning District, pursuant to Subsection 10.08.E.3 of the Land Development Code. The 0.69 acre subject property is located at 305 3rd Street South (Immokalee), in Section 4, Township 47 South, Range 29 East, Collier County, Florida. OBJECTIVE: To have the Board of Zoning Appeals (BZA) approve a Conditional Use Extension (CUE) for a Conditional Use to allow a church in the Village Residential (VR) Zoning District. CONSIDERATIONS: The Tabernacle of Bethlehem Conditional Use was originally approved by the Board of County Commissioners acting as the BZA on March 23. 2005; by Resolution No, 05-134 (see Exhibit A to the attached Resolution), The approval permitted the petitioner to use the existing structure for a house of worship, Expansion or enlargement of the existing structure was prohibited, In conjunction with this Conditional Use, the petitioner also received approval of variances from the I-acre minimum lot area requirement to allow the existing O,69-acre site to be used for a church, and a reduction of the 35-foot required front yard setback to allow a 20-foot setback, a reduction in the nunlber of parking spaces by 14 spaces from the required 33 parking spaces to 19 spaces, and a reduction in the landscape buffer by 5 feet on the north and south property lines from a 15-foot wide type "B" to allow a 10-foot wide type "B" buffer in Resolution No, 05-135, Those variances are still in full force and effect and do not require additional action to extend them, Per Section IO,08,E,1. of the Collier County Land Development Code (LDC), Conditional Uses automatically expire three years from their date of approval if activity on the project has not commenced, The petitioner has not stated a reason why the use has not yet commenced, In any case, Section 10,08,E,3, of the LDC pennits the BZA to grant a maximum one year extension of a Conditional Use upon written request of the petitioner; no reason is required to be provided, ,- The original Conditional Use was approved by the BZA in conjunction with favorable findings made based on the following criteria, pursuant to LDC Section IO,08,02,D: · Granting of the Conditional Use would not adversely affect the public interest; · The specific requirements governing the individual Conditional Use, if any, will be met by the petitioner or variances have been granted to address the requirement; · The proposed change was deemed consistent with the Growth Management Plan (GMP) and the LDC; · Ingress and egress to the property, with particular reference to automotive and pedestrian safety, convenience, traffic flow, and access in case of fire or catastrophe was addressed; · The potential effects of noise, glare, economic or odor effects were mitigated; and CUE-2008-AR-13066: rabernacle of Bethlehem 1 of3 Agenda Item No. 17E June 24, 2008 Page 2 of 70 . The proposed land use was compatible with the existing land use pattern, As the area surrounding the subject site has remained unchanged since the original approval, the subject Conditional Use remains consistent with the GMP and the LDC, Furthermore, all issues relative to access, impacts and compatibility that were addressed at the time of the original approval and made subject to various stipulations that will be carried fOlward with approval of this CUE, FISCAL IMPACT: The Conditional Use Extension approval by and of itself will have no fiscal impact on Collier County, There is no guarantee that the project, at build out, will maximize its authorized level of development, however, if the Conditional Use Extension is approved, and the church use is established in the existing vacant building. the new use could have an impact on Collier County public facilities, The County collects all applicable impact fees before the issuance of building permits to help offset the impacts of each new development on public facilities, These impact fees are used to fund identified projects in the Growth Management Plan Capital Improvement Element as needed to maintain adopted Levels of Service (LOS) for public facilities, Additionally, in order to meet the requirements of Section 1O,02,07(C) of the Land Development Code, fifty percent (50%) of the estimated Transportation Impact Fees associated with the project are required to be paid simultaneously with the approval of each final local development order. Other fees collected before the issuance of a building permit include building permit review fees and the remainder of all applicable impact fees, Finally, additional revenue is generated by application of ad valorem tax rates, and that revenue is directly related to the value of the improvements, Please note that impact fees and taxes collected were not included in the criteria uscd by Staff and the Planning Commission to analyze this petition, GROWTH MANAGEMENT PLAN (GMP) IMPACT: The subject property is designated Urban Residential. High Residential District, on the Immokalee Area Master Plan Future Land Use Map of the Growth Management Plan, Relevant to this petition, this Subdistrict permits non-residcntial uses such as community facilities, which includes churches, Therefore. staff concludes the proposed use for the subject site can be deemed consistent with the Future Land Use Element. TRANSPORTATION IMPACT: No outstanding transportation issues are associated with this petition, The applicant would be required to comply with all applicable developmental regulations when development approvals are sought.
