EXECUTIVE SUMMARY
Request for the Board of County Commissioners to authorize the acquisition of auditing
services to determine if the Clerk of Courts has adhered to the Boards direction,
concerning interest income, as defined in Resolution 2007-257, adopted in September 2007.
OBJECTIVE: For the Board of County Commissioners (Board) to determine if the Clerk of
Courts (clerk) has made unauthorized uses, transfers, and expenditures of the Boards interest
income since the adoption of Resolution # 2007-257 on September 12,2007. [See copy of the
resolution attached as Exhibit "A"].
CONSIDERATIONS: The Boards direction to its clerk in Resolution 2007-257 is clear. The
clerk is directed by the Board to return, in its entirety, interest income earned on Board funds to
the Board on a monthly basis except for necessary costs associated with the investment of the
Board's funds.
The clerks accounting records indicates the clerk has earned $18,673,102.78 of interest on Board
funds since October I, 2007, the beginning of the FY 2008 fiscal year through June 10, 2008.
This interest has been deposited into the clerks' accounts and none of the $18,673,102.78 of
interest earnings has been returned to the Board.

According to the County's Budget Director, the Clerk has expended more than $2,338,488.98 of
the Boards $18,673,102.78 in interest income since the Board, by Resolution, instructed him not
to do so. [See copy of Affidavit ofYonkosky attached hereto as Exhibit "B"].
Honorable Jack Lundy, Circuit Court Judge in the 20th Judicial District, by oral instruction on
March 18,2008 and by written order on June 16,2008 provided that interest income earned by
the clerk on Board funds may not be used, transferred or expended by the clerk without the
authority and direction of the Board [See copy of Judge Lundy's VlTitten order attached hereto as
Exhibit "c'].
In order to determine precisely how the unauthorized use of Board interest income occurred, an
audit is needed of the Clerk's and Board accounts in the custody of the Clerk since Resolution
2007-257 was adopted in September 2007.
Section 125.0 I (x) provides the Board can "Employ an independent certified public accounting
firm to audit any funds, accounts and financial records of the County and its agencies and
governmental subdivisions...."
The money at issue is County money subject to the discretionary spending power of the Board
and the Board has not directed the clerk to keep any of it. The Board has the authority to
determine how County money, including interest earned on County money, is spent.

Florida law provides the clerk must disburse interest earned on Board funds only under direction
by the Board.

FISCAL IMPACT: As of June 10, 2008, $2,338,488.98 of the Boards interest earnings has
been spent by the clerk.
GROWTH MANAGEMENT IMPACT: There is no grov.1h Management impact associated
with this request.
RECOMMENDATION: The Collier County Board of County Commissioners approve the
retention of an independent audit firm to audit the clerks' funds, accounts and financial records
from September 2007 to the present in order to determine how much Board money has been used,
transferred, and expended by the clerk; and under what circumstances this occurred.

RESOLUTION NO. 2007 -~
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLUER COUNTY, FLORIDA. PROVIDING RECOGNmON OF
SECTION 28.33, FLORIDA STATUTES AND CLARIFYING
RESOLUTION 2002 - 227 RELATING TO INTEREST ACCRUING
FROM MONEYS DEPOSITED WITH THE CLERK OF THE CIRCUIT
COURT
WHEREAS. Section 28.33, Florida Statutes, as existing as of May. 2002
provides as follows:
The clerk of the circuit court in each county shall invest county funds in
excess of those required to meet expenses l'S provided in s. 218.415, No
clerk. investing such funds s.hall be liable for the loss of any Interest when
circumstances require the withdrawal of funds pl8ced in a time deposit and
needed for immediate payment of county obligations. Except for Interest
earned on moneys deposited in the registry of the court, all Interest accruing
from moneys deposited shall be deemed income of the office of the clerk of
the circuit court Investing such moneys end shall be deposited in the same
account as are other fees end commissions of the cleric's office. The clerk may
invest moneys deposited in the registry of the court and shall retain as
income of the office of the clerk end 85 l!l rel!lsonable Investment management
fee 10 percent of the interest accruing on those funds with the balance of
such interest being allocated in eccordance with the interest of the depositors.
WHEREAS, when Resoiution 2002 - 227 was approved by the Board of County
Commissioners on the 14th of May, 2002. it was the Board's intent that all interest
earned on County funds invested by the Clerk of Courts of Collier County would be
returned to the Board in its entirety. except for the necessary costs associated wilh the
investment of the funds; and
WHEREAS, the past and present intention of the Board of County
Commissioners Is that all Interest earned by the Clerk of Courts on County money Is to
be remitted to the Board on a monthly basis; and
WHEREAS, the Cierk of Courts has claimed entitlement to the interest earned on
County funds in his 2007- 2008 Annual Budget.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
1. The Clerk of Courts of Collier County is authorized to Invest County funds
pursuant to Florida Statutes, Section 28.33.
2. The Cierk of Courts of Collier County is not and has not been authorized to retain
the interest Income eamed on Board funds.
3. All interest Income earned by the Clerk of Courts of Collier County on Board
funds is to be returned to Board of County Commissioners on a monthly basis.

4. The interest earned by the Clerk on Board funds shall not be treated as fee
Income by the Clerk of Courts of Collier County.
5. The interest on public moneys collected by the Clerk of Courts of Collier County
on behalf of the County for subsequent distribution thereto and invested prior to
distribution must be credited to the County, along with the principal.

6. On June 10,2008, a computer printout reflects that for lhe Fiscal Year ending September
30,2008, the Clerk has received and recorded $18,673.102.78 ofinvestrnent interest
income that belongs to the Board of County Commissioners in the Clerk's non-court
general fund. [See Exhibit "A'1-
7. '''The computer printout identified in Item 6 above, indicates that the Clerk has spent
$2,338,488.98 of the Board's $18,673,102.78 investment interest income in the current
Fiscal Year commencing on October I, 2007.
8. The $2,338,488.98 was used to pay for expenses in the Clerk's non-court general fund in
violation of the Board of County Commissioners' Resolution No. 2007-257, attached
hereto as Exhibit "B~.

Since the Judge's oral instructions on March 18,2008 [See Exhibit "C"] the Clerk has

the partial SUlllTlary judgment, I probably should go
back and try to write something up, but, due to my
time frames, I'm just going to do it verbally today.
I believe -- this Court believes that there is
a conflict between Chapters 218 and 219 and 28.33
and, since there is a conflict, I believe that the
cOllll1On law rule and the' Alachua case and the

Attorney General's opinions would be applicable.
So I do believe that I am going to grant the
motion for partial suurnary judgment.
