Agenda 07/22/2008 Item #16J 5Agenda Item No. 16,15 July 22, 2008 Page 1 of 9 EXECUTIVE SUMMARY RECOMMENDATION THAT THE COLLIER COUNTY BOARD OF COMMISSIONERS APPROVE A RESOLUTION, PURSUANT TO SECTION 101.001(1), FLORIDA STATUTES, TO ALTER PRECINCT BOUNDRIES IN PRECINCT 501 TO BE CONTIGUOUS WITH PRECINCT 502, AND CORRECTING THE BOUNDARIES FOR PRECINCT 505 TO REFLECT ITS TRUE BOUNDARIES TO BE CONSISTENT WITH ITS LEGAL DESCRIPTION. OBJECTIVE: To obtain the Board's approval of a Resolution to allow: (1) the boundaries of Precinct 505 to be changed to reflect the true boundaries of the Port of the Islands Community Improvement District, including those portions of the district laying north of U.S. highway 41, and (2) changing the boundaries of Precinct 501 to be contiguous with Precinct 502, which includes the portion of Collier Seminole State Park containing residences for Park employees. CONSIDERATIONS: Florida Statute § 101.001 gives authority to the Board of County Commissioners to alter or create precincts for voting in the county. When Precinct 505 was created (Resolution 2006 -145) the accompanying map did not reflect that portion of the Port of the Islands Community Development District to the north of U.S. highway 41. At that time, it was the intent of the Supervisor of Elections to include the entire district within the bounds of Precinct 505. In addition, the northwest comer of Precinct 502 includes Collier Seminole State Park. Under the existing boundaries for Precinct 502, park employees and other residents currently are required to drive to Everglades City to vote; a distance of over 20 miles. By incorporating those voters into Precinct 501 their drive to their precinct will be shortened by over 14 miles. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. LEGAL CONSIDERATION: This item has been approved by the County Attorney's Office and is legally sufficient for Board action: —SRT. GROWTH MANAGEMENT: There is no impact to the Growth Management Plan associated with this Executive Summary. RECCOMENDATION: That the Board of County Commissioners approve a Resolution altering precinct boundaries in Precinct 501 to be contiguous with Precinct 502, correcting the boundaries for Precinct 505 to reflect its true boundary consistent with its legal description, and authorizing its Chairman to sign the attached Resolution reflecting those changes. . WHEREAS, § 101.001(1), Florida Statutes, authorizes the Board of County Commissioners in each county, upon recommendation and approval of the Supervisor of Elections, to alter or create precincts for voting in the county; and WHEREAS, such recommendation and approval has been given by the Supervisor of Elections to alter Precincts 501 and 502 and 505 to: (1) reduce voter confusion by ensuring that voters are placed at a polling site as close as possible to their residence and (2) reflect true boundaries for precincts based on the legal description; and WHEREAS, each precinct is numbered and, as nearly practicable, composed of contiguous and compact areas and the Supervisor of Elections has designated or will designate a polling place at a suitable location within each precinct; and WHEREAS, the Supervisor of Elections, in accordance with § 101.001(3), Florida Statutes, will maintain a suitable map drawn to scale no small than 3 miles to the inch and clearly delineating all major observable features such as roads, streams, and railway lines and showing the current geographical boundaries of each precinct, representative district, and senatorial district, and other type of district in the county subject to the elections process in the Florida Statutes; and WHEREAS, the Supervisor of Elections will notify the Secretary of State in writing within 30 days of this reorganization of precincts and will furnish a copy of the map showing the current geographical boundaries and designation of each altered precinct, in accordance with § 101.001(3), Florida Statutes; and WHEREAS, within 10 days after the precinct changes recommended herein are adopted the Supervisor of Elections will post a copy of the document describing such changes in the Supervisor's office, in accordance with § 101.001(4), Florida Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE BOAD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that the precincts of the following boundaries shall be changed as follows: Precinct 501 is altered and those changes are contiguous to Precinct 502 and with boundaries contiguous to Collier Seminole State Park. Precinct 505 is altered to reflect true boundaries for precincts based on the legal description.
