Agenda 07/22/2008 Item #16D 8Agenda Item No. 161D8 July 22, 2008 Page 1 of 11 EXECUTIVE SUMMARY Recommendation to adopt a Resolution establishing the Collier County Domestic Animal Services Fee Policy as of October 1, 2008 and superseding resolutions 95- 107, 95 -106, 93 -404, and all other resolutions establishing animal services - related fees Objective: To establish user fees which will partially offset the cost of providing domestic animal services to the taxpayers of Collier County. Considerations: Concurrent to this item, the Board of County Commissioners is hearing the adoption of proposed changes to the Collier County Animal Control Ordinance. Among the changes proposed for adoption is the elimination of fees specified in the Ordinance and allowing for fees to be established and revised via resolution. Staff has prepared a comprehensive fee policy, incorporating fees established in the previous Ordinance and several resolutions. Staff is proposing increasing some but not all of the fees. The most recent fee increases were implemented in 2001. A summary of proposed increases/changes is as follows: • Increase impoundment fees by $15 when an animal is picked up by an Animal Control -' Officer (as opposed to dropped off by a Good Samaritan), to defray rising fuel costs. • Institute a split fee for impounded livestock based on weight, to minimize the risk of abandonment of livestock whose market value is significantly lower than the impoundment fee. • Institute mandatory spay /neuter fees upon return to owner after impoundment as contemplated in the proposed Ordinance. Fees are established in accordance with Collier County's Agreement with local veterinarians. • Institute an owner surrender fee, to defray the cost of disposition of such animals. • Increase dog or puppy adoption fees, but not cat or kitten adoption fees, in response to market conditions. • Increase licensing fees, to defray the cost of licensing renewal notification. • Institute a micro - chipping fee for adopted animals (currently included in the adoption fee). • Increase kennel, pet shop, stable, and rodeo permits to defray the cost of staff inspection efforts. • Institute meeting room rental fees, as a new potential source of revenue. • Update euthanasia and cremation service fees. As a summary for changes in adoption fees: • Current cat/kitten adoption fee is $40, which includes spay /neuter and micro -chip, plus $8 for a license, totaling $48. Proposed cat/kitten adoption fee remains $40, which will include spay /neuter, plus $10 microchip and $10 license, for a total of $60 (overall, a $12 increase). Agenda Item No. 16D8 July 22, 2008 Page 2 of 11 • Current dog /puppy adoption fee is $50, which includes spay /neuter and micro -chip, plus $8 for a license, totaling $58. Proposed dog /puppy adoption fee is $65, which will include spay /neuter, plus $10 microchip and $10 license, for a total of $85 (overall, a $27 increase). Staff has prepared a table, attached, comparing established versus proposed fees. Fiscal Impact: Proposed fee increases are anticipated to yield an additional $42,600 in general fund revenue in FY 2009. Growth Management Impact: No Growth Management Impact is associated with this action. WHEREAS, the Director of Animal Services has recommended to the Board of County Commissioners that a complete Domestic Animal Services Fee Policy be established as follows; WHEREAS, the Board of County Commissioners hereby accepts the recommendations of the Director of Animal Services; NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY THAT: 1. The Collier County Domestic Animal Services Fee Policy is hereby established as follows. This Policy supersedes policies as established in Resolutions 95 -107, 95 -106, 93 -404, and all other Resolutions establishing animal services - related fees: 1. PURPOSE The purpose of this policy is to establish user fees which will partially offset the cost of providing domestic animal services to the taxpayers of Collier County. H. LIMITATIONS No Waiving of Fees. The Board of County Commissioners shall set all fees and charges. No fees may be waived, except as stated herein. Non - Fee - Related Policies. The Director of Animal Services, or designee, may waive enforcement or application of any department policies or restrictions provided such waiver does not conflict with applicable local, state, or federal laws and does not interfere with public safety. Promotional Sales and Advertisements. Fees may be reduced from time to time for special promotional sales and advertisements if approved by the Director of Animal Services and such a reduction is applied in a consistent and time - limited manner. Examples may include but are not limited to: Two- for-one cat adoptions in June to recognize National Adopt -A -Cat Month, or reduced adoption fees in February for senior citizens. Service Animals. All fees associated with services provided to service animals, as defined in F.S. 413.09, are waived. Safekeeping. If an animal is impounded at the request of a first- responding agency due to the death, medical emergency, or disaster- related circumstance of its owner or caretaker, and that animal is claimed by the owner, next of kin, or otherwise authorized party before the end of the next business day after impoundment, impound fees may be waived. This exception does not apply to animals of owners or caretakers who have been arrested or incarcerated. Refunds. The following fees are nonrefundable: Impoundment Fees, Owner Surrender Fees, License Fees, and Permitting Fees. The following fees are refundable only if service is not rendered: Mandatory Spay/Neuter Fees and Micro - chipping Fees. Euthanasia and Cremation Service Fees may be Agenda Item No. 16D8 July 22, 2008 Page 5 of 11 refunded at the discretion of the Director of Animal Services, or designee, upon written request received within 30 days of payment or receipt of service, whichever comes first. Adoption fees will be refunded within seven days of placement if 1) the animal is returned to Domestic Animal Services or, 2) the adopter can demonstrate non - routine veterinary medical expenses in excess of the amount ofthe adoption fee. Adoptions are considered "as is," and no expenses beyond the adoption fee will be reimbursed. Adopted animals may be returned between the eighth and the 30th day after placement without incurring an owner surrender fee, but the adoption fee will not be refunded. On the 31st day and all those thereafter, an owner surrender fee will be incurred for adoption returns. Days are counted as calendar days, irrespective of Domestic Animal Services open -to -the public hours. 111.
