Agenda 07/22/2008 Item #16C 5Agenda Item No. 16C5 July 22, 2008 Page 1 of 6 EXECUTIVE SUMMARY Recommendation to have the Chairman execute a Declaration to the Public in the deed records in the Office of the Clerk of the County evidencing the closure of the Immokalee Sanitary Landfill; recording cost not to exceed $27. OBJECTIVE: The public purpose is to comply with the Florida Department of Environmental Protection (FDEP) requirement regarding closure procedures for landfills. CONSIDERATION: The Immokalee Sanitary Landfill located at 700 Stockade Road, Immokalee, Florida stopped receiving solid waste in August, 2004, and was capped in 2008. As part of the Landfill Operating Agreement, Waste Management, Inc. built a new transfer site at the Immokalee Landfill location. An FDEP permit was issued certifying construction completion as of June 27, 2008. Florida Administrative Code (FAC) Rule 62- 701.610(5) states that "After closing operations are inspected and approved by the Department, the landfill owner or operator shall file a declaration to the public in the deed records in the office of the county clerk of the county in which the landfill is located. The declaration shall include a legal description of the property on which the landfill is located and a site plan specifying the area actually filled with solid waste. The declaration shall also include a notice that any future owner or user of the site should consult with the Department prior to planning or initiating any activity involving the disturbance of the landfill cover, monitoring system or other control structures. A certified copy of the declaration shall be filed with the Department." A Declaration to the Public, together with the required legal description and site plan, has been prepared in accordance with the above stated FAC Rule. FISCAL IMPACT: The total cost will not exceed $27 for recording the Declaration to the Public. Funds are available for recording under Solid Waste Disposal Fund #470. LEGAL CONSIDERATION: This item complies with the requirements of Rule 62- 701.610, F.A.C. and is legally sufficient for the Board of County Commissioners' consideration. - JAB GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. RECOMMENDATION: That the Board: Authorize the Chairman to execute the Declaration to the Public; and 2. Direct the County Manager or his designee to proceed to follow all appropriate procedures and to record the Declaration to the Public in the Public Records of Collier County, Florida. DECLARATION IS HEREBY FURTHER GIVEN that any future owner or user of this site should consult with the Florida Department of Environmental Protection prior to planning any activity that might disturb the landfill cover, monitoring system or any other control structure.
