Executive Summary
Recommendation that the Board of County Commissioners provide staff
direction and authorization on how to proceed with management of the Clam
Bay Estuary.
Objective: Request that the Board of County Commissioners provide staff direction and
authorization on how to proceed with management of the Clam Bay Estuary.
Considerations: At the June 24, 2008, Board of County Commissioners' meeting, staff was
directed to develop a proposal for the County wide management of the Clam Bay Estuary.
Direction was given that this Estuary be managed for the benefit of all the citizens of Collier
County and not one individual neighborhood, organization or municipality. This management
plan would be inclusive of the entire estuary and be managed/represented by surrounding
municipalities and stakeholders.
Coastal Zone Management staff along with the County Manager's Office considered three
options in developing this management plan. They are:
1. Option 1 would develop a Clam Bay Advisory Committee appointed by the Board of
County Commissioners and reporting directly to the Board of County Commissioners.
2. Option 2 would place the management of the Clam Bay estuary directly under the control
of the Coastal Advisory Committee (CAC), and
3. Option 3 would develop a Clam Bay Advisory Committee appointed by the Board of
County Commissioners but reporting directly to the Coastal Advisory Committee.
While all three options could work successfully, staff is in favor of a separate Clam Bay
Advisory Committee appointed by the Board of County Commissioners and reporting directly to
the Coastal Advisory Committee. This organization would place the oversight of this estuary in
a highly respected board while at the same time allowing a focused management with the
directly affected stakeholders.
The Coastal Advisory Committee was created under Ordinance 2001 -03 in February 2001 to
advise and make recommendations to the Board of County Commissioners in matters pertaining
to Coastal Zone Management policies including coastal and estuarine habitat protection and
restoration (Section D). The Coastal Advisory Committee is an established and respected cross
County board with a history of dealing with difficult issues fairly. The Board includes three
members from the County; three from the City of Naples, and three from the City of Marco
Island.
A Clam Bay Advisory Committee would be specifically focused to deal with the specific issues
of Clam Bay. Staff recommends a seven member committee that would make recommendations
to the Coastal Advisory Committee and Board of County Commissioners on the management of
the Clam Bay Estuary and would include the following members:

• 1 representative of the Pelican Bay Services Division (PBSD) which would be either the
Government Affairs Chairman of the PBSD or the Chairman of the PBSD.
• 1 representative from the Pelican Bay Foundation (PBF) that is a member of the PBF
Board.
• 1 representative from the City of Naples that is a councilperson.
• 1 representative from Seagate that is a member of the Seagate Homeowners Association
Board.
• 1 representative from District 1
• 1 representative from District 3
• 1 representative from District 5
The Clam Bay Advisory Committee would be tasked with addressing the immediate permit
issues, development of a comprehensive long term master plan and the day to day operation of
this estuary.
Advisory Committee Recommendations: No Advisory Committees have reviewed or
contributed to this proposal.
County Attorney Findings: If a new advisory board (or committee) is approved, the Board of
County Commissioners will create the advisory board by ordinance in compliance with
Ordinance No. 01 -55 § 3. The County Attorney's Office has reviewed and approved this item.
It is legally sufficient for Board action. — CMG
Fiscal Impact: The Clam Bay Advisory Committee would address funding requirements and
bring recommendations back to Coastal Advisory Committee and Board of County
Commissioners. TDC funds would not be used to manage the Clam Bay Estuary. TDC fund
would be managed distinct and different from funds used to manage this estuary. Prior to the
advertised public hearing to adopt a new advisory board ordinance, staff will advise the BCC of
the costs, both direct and indirect, of establishing and maintaining the new board in compliance
with Ord. No. 01 -55 § 3.
Growth Management Impact: No impact to the growth management plan would result from
this board action.
Staff Recommendations: For the Board of County Commissioners to establish a seven member
Clam Bay Advisory Committee appointed by the Board of County Commissioners and reporting
directly to the Coastal Advisory Committee for management and control of the Clam Bay
Estuary.
