Agenda 10/14/2008 Item #16D26emr, No. 16u26 0etober 14, 2008 Page 1 of 7 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners approve and authorize the Chairman to sign an agreement with Financial Marketing Concepts, Inc. for a discount pharmacy card to be distributed free of charge to Collier County residents. OBJECTIVE: To enter into an agreement with Financial Marketing Concepts, Inc. for the production and distribution of a discount pharmacy card fbr residents of Collier County. CONSIDERATIONS: In February of 2007, the Physician Led Access Network (PLANT) launched a community wide distribution of a discount prescription card free of charge for Collier residents in partnership with the Collier County Medical Society. Collier County Government assisted in the county -wide distribution by making cards available at various public facilities. Upon direction from the County Manager's Office, representatives from the Public Services Division met with Financial Marketing Concepts, Inc., a Florida corporation, to discuss an offer to provide all Collier County residents free access to a Coast2Coast discount prescription card in early August of 2008. �- Upon review of the proposal, staff recommends that the County enter into an agreement with Financial Marketing Concepts, Inc. to provide additional benefits to the residents of Collier County. Besides offering a greater phanmaceutiea] discount. other benefits include: • Toll free customer service number • Education of all local pharmacies and direct distribution and toll free number for pharmacists and input codes for discounts • Production, distribution and claims processing costs of the cards • Develop and maintain a web site for Collier County residents — This prescription card will generate approximately $25 per prescription filled for Collier County and it is staff's recommendation to donate that revenue to the Physician Led Access Network in support of their mission to serve the uninsured and underinsured of Collier County. FISCAL IMPACT: No general funds will be used to fund this initiative. GROWTH MANAGEMENT IMPACT: There is no growth management impact. Tamiami Trail, County Courthouse, Naples, Florida 34112- -4961. WITNESSETH: WHEREAS, FMC has crated a discount pharmacy card, to -wit: Coast2 Coast Rx Card, which provides discounts on preIpeription drugs to individuals, families, and county residents at no cost, and WHEREAS, FMC can provide COUNTY the opportunity to offer its Coast2 Coast Rx discount pharmacy card to its residents at no cost to the COUNTY, and WHEREAS, COUNTY isl desirous of providing the Coast2Coast Rx discount pharmacy card to its residents at no cost to the COUNTY. NOW, THEREFORE, in I'iconsideration of the mutual terms, covenants and conditions herein contained, it is agreed as f�llows: 1. Benefits. FMC Will provide its Coast2Coast Rx discount pharmacy card at no cost to COUNTY, and will pay COUNTY a Royalty for each prescription filled that results in a paid claim as listed on Schedule'hA" hereof. 2. Term. This AgrLment will automatically renew on the one -year anniversary date for another year term unl s either party gives the other party thirty (30) days written notice to terminate, or unless earlier terminated by default. Royalty to COUNTY will continue I to be paid by FMC as long as its �esidents continue to fill prescriptions under this program and as long as FMC receives its compensation for those prescriptions. 3. FMC's Obligations. FMC will provide to COUNTY the opportunity to provide COUNTY residents its free CoaIt2Coast Rx discount pharmacy card at no cost and will pay a Royalty to COUNTY based on tho use thereof for the Coast 2Coast Rx Card. FMC will �andle all administration of the card including the providing of monthly usage reports to COUNTY. FMC will assign a unique Group Code to COUNTY for cards printed by FMC so that �OUNTY'S Royalty can be tracked when the card is used at Participating pharmacies by CO JUNTY residents. i C. FMC wilt distribute its Coast2Coast Rx Cards to participating pharmacies in the COUNTY anti to other such governmental offices (such as libraries, health departments, etc.) designated by the COUNTY. d. FMC will create a private label website for the COUNTY to link to from its website that will describe th q Coast2Coast Rx Card program, and COUNTY residents will have the ability to print a card from such website. e. FMC will promote the card for the COUNTY in all media formats appropriate, including newspaper, radio, and the internet through press releases and in conjunction with the COUNTY'S efforts to promote the card to its residents. i f. Gov ming Law iand Venue. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, and venue for any proceedings g shall be in Collier County, Florida. i 6. Notice.
