EXECUTIVE SUMMARY
Recommendation for the BCC to approve an amendment to a previously
executed sub-lease agreement with the City of Marco Island for boat dock
improvements and usage of the Caxambas boat dock marina.
Objective: To execute an amendment to the "Sublease Agreement" with the
City of Marco Island (Sublessee) dated June 26, 2007, modifying the terms and
conditions of article 6.
Considerations: On June 26, 2007, the Board of County Commissions entered
into a "Sublease Agreement" with the City of Marco Island to lease approximately
six hundred sixty (660) square feet combined with land and area over water at
Caxambas Marina located at 909 Collier Court, Marco Island, Florida, for the
purpose of installing, a "Boat Dock and Boat Lift" for the City of Marco Island's
Fire Rescue and Police Vessel. The cost of maintenance, expenses,
engineering fees, and construction cost will be at the sole expense of the City of
Marco island.
The previous terms and conditions of "Article 6" authorized the "Sublessee" to
assume the sole responsibility of implementing all required construction related
improvements associated with the installation of the "Boat Lift and Boat Dock" as
indicated above. However, the County staff will assume full responsibility to
solely manage and coordinate the design engineering services and construction
related services to construct the "Boat Dock improvements" in conjunction with
the existing Caxambas boat dock expansion project consistent with the
stipulations of this executive summary.
Legal Considerations: The County Attorneys Office has reviewed and
approved the amendment. It is legally sufficient for Board action. -CMG
Fiscal Impact: No fiscal impact is associated with this agreement.
Growth Management Impact: The facility will not be inventoried for Growth
Management Plan compliance.
Recommendation: That the Board of County Commissioners approves the
attached sub-lease agreement amendment with the City of Marco Island, and
authorize the chairman to sign upon approval by the City of Marco Island City
Council.

FIRST AMENDMENT
SUBLEASE AGREEMENT FOR BOAT LIFT AND DOCK
AT CAYAMBAS MARINA
This First Amendment to the Sublease Agreement for Boat Lift and Dock at Caxambas
MAnria, made this _ day of , 2008, (hereinafter "First Amendment "), is
entered into by and between Collier County (hereinafter "COUNTY'), and the City of Marco
Island (hereinafter "MARCO ISLAND").
W ITN ESSETII:
WHEREAS, the COUNTY and MARCO ISLAND entered into a Sublease Agreement
for Boat Lift and Dock at Caxambas Marina dated June 26, 2007 (the "Agreement "); and
WHEREAS, the COUNTY and MARCO ISLAND desire to further amend the terms of
the Agreement.
NOW, THEREFORE, in consideration of valuable consideration and the premises and
mutual covenants hereinafter set forth, the parties agree as follows:
Article 6 of said Agreement is hereby deleted in its entirety retroactively to the effcctivc
date of the Agreement. The following provision shall replace Article 6.
Collier County, CoaNtal Zone Management, shall be responsible for the design,
permitting, and construction of the boat dock improvements to be constructed in
conjunction with the existing Caxambas Boat Dock expansion project, the boat dock
plans and specifications shall be reviewed by the Sublessee for adequate sufficiency.
Except as provided herein, the Agreement shall remain in full force and effect
IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed
