Agenda 10/14/2008 Item #16B10Aaena Item No. 16B10 Octaber 14, 2008 Wage 1 or 4 q. EXECUTIVE SUMMARY Recommendation to approve two one -year traffic reservation extensions associated with the approval of the Traffic Impact Statement submitted with the Cirrus Point SDP AR #10427. OBJECTIVE: To obtain Board of County Commissioners' approval for two one -year traffic reservation extensions associated with an approved Traffic Impact Statement (TIS) for 108 condominium units submitted with the Cirrus Point approved SDP AR #10427. CONSIDERATION: On February 27, 2007, the TIS submitted as part of the Site Development Plan (SDP) application for 108 condominium units for Cirrus Point was approved. The traffic reservation associated with the TIS approval expired on February 28, 2008, however, the SDP still has not been issued and the applicant would like to extend the traffic reservation both retroactively from February 28, 2008 and prospectively for a further one -year extension. Pursuant to Section 10.02.07.C.4.f. of the Land Development Code, traffic capacity reservations will "expire in one (1) year, from TIS approval and determination of available capacity, unless ...the Board approves an extension to the one (1) year time period." The applicant is requesting the Board approve a one -year- extension retroactively from February 28, 2008 to February 27, 2009 and a second extension from February 28, 2009 to February 28, 2010 for the traffic reservation. The applicant is still waiting to begin the project but would like to extend the traffic reservation. Based on Transportation Services' updated AU[R and concurrency database, the adjacent roadway network has a significant amount of remaining capacity. Thomasson Drive has a remaining capacity of 652 peak hour peak direction trips and Bayshore Drive has a remaining capacity of 1,203 trips. There are no anticipated projects proposed in the area that would eliminate capacity for this project through the requested 2010 extension. Rather than return with this item in a few months for another one -year extension, staff is requesting approval of the above - referenced one -year extensions at this time. FISCAL IMPACT: There is no fiscal impact for this extension approval. LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office and is legally sufficient for Board action. —SRT GROWTH MANAGEMENT IMPACT: The proposed traffic reservation extension for this project is consistent with the County's Growth Management Plan. RECOMMENDATION: The Board approves a one -year extension retroactively from February 28, 2008 to February 27, 2009 and a second extension from February 28, 2009 to February 28, 2010 for the traffic reservation associated with the TIS approval, and authorize the County Manager or his designee to prepare the necessary documentation to comply with the Board's direction.
