Agenda 10/14/2008 Item #16B 1Agenda Item No. 16131 October 14, 2008 Page 1 of 4 EXECUTIVE SUMMARY Recommendation to adopt a Resolution of the Board of County Commissioners of Collier County prohibiting the operation of trucks and other commercial vehicles having a rated load- carrying capacity in excess of one (1) ton from through- movements on Oaks Boulevard. OBJECTIVE: To obtain approval from the Board of County Commissioners (BCC) to adopt a Resolution to prohibit through - movement truck traffic on Oaks Boulevard. CONSIDERATIONS: Oaks Boulevard is within a developed residential area and is not conducive to heavy truck traffic. In accordance with the provisions of Ordinance No. 83 -35 (codified in the Code of Laws and Ordinances of Collier County at § 130 -3(a) and (c)), which provides authority to regulate truck and other commercial vehicular traffic upon designated roads and streets in Collier County, and in view of the results of the engineering study, staff is recommending that trucks and other commercial vehicles having a rated load- carrying capacity in excess of one (1) ton be prohibited from making through movements on Oaks Boulevard. FISCAL IMPACT: The estimated cost of installing the two necessary "NO THROUGH TRUCKS OVER I TON" signs is $200 and is budgeted within the Traffic Operations Budget Fund 101. LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office and is legally sufficient for Board action. —SRT GROWTH MANAGEMENT IMPACT: This Resolution is consistent with the County's Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida approve the Resolution prohibiting the operation of trucks and other commercial vehicles having a rated load - carrying capacity in excess of one (1) ton from through - movements on Oaks Boulevard, authorize the Chairman to execute the Resolution, and direct the County Manager or his designee to erect the appropriate traffic control signs. Mudd County Manager Date Bcard of County Commissioners County t"anager's Office 9"2512008 1:43 PM file //C \AoenrlaTPCtlF.xnnrt11 14-C)ctnht-0/0014 01 )(),mmitF o/.,)ncn,,\icP\t,ro/,,?OAC',P\Tn I WRY"WR Agenda Item No. 16B1 October 14, 2008 Page 3 of 4 RESOLUTION NO. 2008- A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA, PROHIBITING THE OPERATION OF TRUCKS AND OTHER COMMERCIAL VEHICLES HAVING A RATED LOAD - CARRYING CAPACITY IN EXCESS OF ONE (1) TON FROM THROUGH - MOVEMENTS ON OAKS BOULEVARD, WHEREAS, Chapter 316, Florida Statutes, permits the Board of County Commissioners to prohibit or regulate any class or kind of traffic found to be incompatible with the normal and safe movement of traffic on roads and streets under its jurisdiction; and WHEREAS, Sec. 130 -3(a) of the Code of Laws and Ordinances of Collier County provides in relevant part that "No person shall operate any truck or other commercial vehicle with a rated capacity in excess of one ton upon any road or street in the county whenever such road or street is posted with signs prohibiting such operation...;" and WHEREAS, See. 130 -3(c) of the Code of Laws and Ordinances of Collier County provides in relevant part that "The county administrator is authorized to determine those roads and streets upon which such roads are to be prohibited, and ... with the approval of the board of county commissioners by resolution, shall cause signs to be posted giving notice thereof on the roads and streets so designated...;" and WHEREAS, an engineering study by the Collier County Traffic Operations Department has indicated that heavy truck througb -traffic is not compatible with existing road conditions and road usage along Oaks Boulevard since the street is within a fully developed, residential area not conducive to heavy truck traffic; accordingly the Collier County Traffic Operations Department and the County Manager recommends that such heavy truck through - traffic be prohibited. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMNIISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board of County Commissioners does hereby prohibit the operation of trucks and other commercial vehicles having a rated load- carrying capacity in excess of one (1) ton from through- movements on Oaks Agenda !fern No. 16D1 October 14, 2008 Face 4 of 4 Boulevard and does hereby direct the County Manger on his designee to erect signs giving notice thereof after notification to the Collier County Sheriff: Be it further resolved that a copy of this resolution be forwarded to the Collier County Sheriff's Office for proper enforcement of this prohibition.
