EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approve and
authorize the Chairman to sign Change Order No. 1 to File No. DRI 05-06 with
Inspired Woodworking for Project 4984 23RD Court SW, Naples, Florida (Folio No.
36110800009) and ratify Staff approval of project expenditures.
OBJECTIVE: To increase the scope of work under File No, DRI 05-06 with Inspired
Woodworking for Project 4984 23rd Court SW, Naples, Florida 34116 and ratify Staff
approval of project expenditures,
CONSIDERATIONS: On March 3, 2008, the Department of Housing and Human
Services, DRI Program Participant William Szempruch, and Contractor Inspired
Woodworking entered into a Contract for Rehabilitation of Owner-Occupied Dwelling
Unit for residential rehabilitation of 4984 23rd Court SW, Naples, Florida 34116, During
construction, the contractor encountered unanticipated mold damage caused by
Hurricane Wilma which required extensive mold mitigation, In order to complete and
correct the existing health and safety issues on subject property, additional rehabilitation
is required and included in Change Order No, 1, which is attached and itemizes the
changes required,
..- FISCAL IMPACT: The fiscal impact of Change Order No, 1 is $35,050,00 and sufficient
grant funds have been committed to fully fund the project, as amended, Source of
Funds are Distaster Recovery Initiative (DRI) grant funds, No general funds are being
used,
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this action,
LEGAL CONSIDERATIONS: Some of work being authorized with this change order
has already been completed based on Staff direction, If the Board of County
Commissioners denies this change order, the contractor may have a claim for the fair
market value of his work based on quantum meruit. This is not an opinion of the
sufficiency of the claim but notice to the Board that such a claim may exist. The Board
may legally approve this change order and ratify Staff actions, - CMG
RECOMMENDATION: That the Board of County Commissioners approve and authorize
its Chairman to signed Change Order No, 1 to Fiie No, DRI 05-06 with Inspired

claims of the Contractor arising out of or related to the change set forth herein, including claims for impact and
delay costs,
