EXECUTIVE SUMMARY
Recommendation for the Board of County Commissioners to approve and
authorize the Chairman to sign Amendment No.1 with the FWCC, Derelict Vessel
Removal (FBIP) Grant Contact No. 07-071, that will provide grant funds in the
amount of $80,000 and approve all necessary budget amendments.
OBJECTIVE: Obtain approval of Amendment NO.1 to the FWCC for the FBIP Grant
Application No. 07-045 for the removal of derelict vessels from the waters of Collier
County.
CONSIDERATIONS: The FBIP derelict vessel grant provides funding to remove
derelict vessels within Collier County utilizing up to $80,000 of FWC's funding. A
$20,000 cash match from Collier County and a $10,000 non-cash match from Collier
County is required. The non-cash match includes staff time, equipment, gas and any
additional items required for this project.
The original contract was approved by the Board of County Commissioners on January
15, 2008. The approval of this amendment will allow for removal of additional derelict
vessels in the waters of Collier County.
This amendment is necessary for the following reasons:
1. If needed the attached derelict vessel list may be changed subject to mutual
agreement from both parties.
2. The total project cost went from $120,000 to $110,000 due to the amount of
match funding available for this project from Collier County.
3. The derelict vessel list from the original agreement is replaced with Attachment
B 1, Revised Derelict Vessel list.
COUNTY ATTORNEY FINDING: The County Attorney's Office has reviewed and
approved this contract amendment. It is legally sufficient for Board action. - CMG
FISCAL IMPACT: Approval of this item will provide $80,000 of state funding to perform
derelict vessel removal. The $20,000 match has been set aside for this project in
MSTD General Fund (111) - the Coastal Zone Management appropriation center - and
this dollar match will be moved via budget amendment to Natural Resources Grant fund
(117) thus aligning expense with the appropriated grant.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.
RECOMMENDATION: Recommendation for the Board of County Commissioners to
approve and authorize the Chairman to sign Amendment NO.1 with the FWCC, Derelict
Vessel Removal (FBIP) Grant Contact No. 07-071, and approve all necessary budget
amendments.

AMENDMENT NO.1 TO AGREEMENT
This AMENDMENT TO AGREEMENT is entered inlo by and between the FLORIDA FISH AND
WILDUFE CONSERVATION COMMISSION ("COMMISSION") and tile COLLIER COUNTY BOARD OF
COUNTY COMMISSIONERS ("GRANTEEj, and amends that Agreement entered into betwean the
COMMISSION and tile GRANTEE dated January 28, 2008. and hereinafter referred 10 as the 'ORIGINAL
AGREEMENT".
IN CONSIDERATION of the mutual covenants and conditions set forth herein and In the
ORIGINAL AGREEMENT. the parties agree to amend the ORIGINAL AGREEMENT as follows, which
amendments shall govem 10 the excluslon oJ any provision of the ORIGINAL AGREEMENT to tile
contrary:
1. Paragraph 3 oflhe ORIGINAL AGREEMENT Is hereby amended 10 read as follows:
The GRANTEE shall implement and complele Its project proposal as described in Attachment A.

public waters of the stale all derellc1 vessels listed in Attachment B-1. Revised Derelict Vessel USf,
attached herato and made a part heteot. However, pending avallable funding. the COMMfSSION
may, by wrillen order designated to be a Change Order, add vessels to Attachment B-1, Revised
Derena Vessel UsL All Change Orders are subject to the mullJal agreement 01 both parties as
evidenced in writing. All vessels added to Attachment B-1, Revised Derelict Vessel List, must be
documented as a derelict vessel by a swom law enforcement officer and verified by a COMMISSION
taw enforcement officer before being added to Ihe Revised Derelict Vessel List. AU project activities
must be completed during the lime span provided herein for thai portion of the Agreement.
2. Paragraph 17 of the ORIGINAL AGREEMENT Is hereby amended to read as foUows:
This Ag.-nent shall begin upon execution by both parties and end June 30, 2009. inclusiVe.
The GRANTEE shall not be eligible lor reimbursemenllor services rendered prior to the
execution date of this Agreement nor after the telTOination dale of 1I1e Agreement.
3. Paragraph 20 of the ORIGINAL AGREEMENT is hereby amended to read as follows:
Th9 maximum amount of compensatIOn shown In paragraph 19 Is besed on the GRANTEE's
estimated total project cost of $110.000 in FBIP Applicalion No. 07-G45. If the actual cost of the
projsct is lesS than the estimated total project cost, compensation by the COMMISSION shall nol
exceed 73% 01 the actual total project cost.
4. Attachment B. Derelict Vessel US!, of the ORIGINAL AGREEMENT is hereby replaced in lIB
entirety with Allachment 8.1, ReVised Derelict Vessel List.
All provisions of the ORIGINAL AGREEMENT not specifically amended herein shall remain In lull
farce and effect.
