Recommendation to authorize refund of water and wastewater impact fees on
permit 2008020167 for Tropical Smoothie Cafe to Phillip T. Woodhouse in the
amount of $3,669.43, in accordance with direction by the Collier County Board of
County Commissioners on September 9, 2008, Item 68.
OBJECTIVE: To obtain authorization to refund water and wastewater impact fees on
permit 2008020167 for Tropical Smoothie Cafe to Phillip T. Woodhouse in the amount
of $3,669.43, in accordance with direction by the Collier County Board of County
Commissioners on September 9, 2008, Item 6E.
CONSIDERATIONS: On September 9, 2008, Item 6B, the Board directed staff to
administratively revise permit 2008020167 and its Certificate of Occupancy to reflect 34
seats as opposed to the 42 seats previously submitted, and refund water and wastewater
impact fees related to the difference.
Community Development and Environmental Services revised the permit and Certificate
of Occupancy to reflect the requested 34 seats.

FISCAL IMPACT: There will be a negative fiscal impact to fund 411 for water impact
fees refunded in the amount of $1,808.24 and a negative fiscal impact to fund 413 for
wastewater impact fees refunded in the amount of$1 ,861.19, for a total of $3,669.43.
LEGAL CONSIDERATIONS: The Consolidated Impact Fee Ordinance, specifically
Section 74-202 of the Code of Laws and Ordinances, allows for this reimbursement.
This item has been reviewed by the County Attorney, and is legally sufficient for Board
action. - JAB
GROWTH MANAGEMENT IMPACT: There IS no growth management impact
associated with this request.
RECOMMENDATION: That the Board of County Commissioners, as the Ex-Officio
Governing Board of the Collier County Water/Sewer District authorize refund of water
and wastewater impact fees on permit 2008020167 for Tropical Smoothie Cafe to Phillip
T. Woodhouse in the amount of $3,669.43, in accordance with direction by the Collier
County Board of County Commissioners on September 9, 2008, Item 6E.
