Agenda 11/18/2008 Item #10A Agenda Item No. 10A November 18, 2008 Page 1 of 4 EXECUTIVE SUMMARY Recommendation to approve a Resolution of the Board of County Commissioners of Collier County, Florida, in support of an amendment of the Florida Statutes to require election ofthe governing Board mcmbers of the Florida Water Management Districts rather than by Governor appointment OBJECTIVE: To approve a Resolution (attached) of the Collier County Board of County Commissioners (BCC) in support of an amendment of the Florida Statutes to require election of the governing Board members of the Florida Water Management Districts, which currently are made by Governor appointment. Once approved by the Board of County Commissioners, the Resolution will be transmitted to members of the Collier County Legislative Delcgation and the Florida Association of Counties. CONSIDERATION: At the BCC regular meeting on October 28,2008, the Board voted during review and adoption of Collier County's 2009 State Legislative Prioritics (Item] OC) to also include adding the following prioTity to the list: Support amending Florida Statules to elect rather than appoint Florida Water Management District governing Board members. The same Resolution was approved previously by the BCC on September 26, 2006 (Resolution 2006-257 attached) and the issue was subscquently included in the list of Collier County 2007 State Legislative Prioritics. FISCAL IMPACT: 1nere is no fiscal impact associated with this executive summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this executive summary. LEGAL CONSIDERATIONS: This itcm raiscs no legal issues. -JAK RECOMMENDATION: That the Board of County Commissioners approves a Resolution in support of an amendmcnt of the Florida Statutes to require election of the governing Board members of the Florida Water Management Districts rather than by Governor appointment. Agenda Item No. 10A November 18, 2008 Page 2 of 4 RESOLUTION NO. 2008 - A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, IN SUPPORT OF THE AMENDMENT OF THE FLORIDA STATUTES TO REQUIRE ELECTION OF THE GOVERNING BOARDS OF THE FLORIDA WATER MANAGEMENT DISTRICTS WHEREAS, the State is divided into five (5) Water Management Districts, which were created to manage and improve water quality, water supply, provide flood control and to protect and enhance natural systems through land and water management; and WHEREAS, each Water Management District is a special taxing district authorized by law to collect ad valorem (property) taxes from landowners located within theiT multiple county jurisdictions; and WHEREAS, current Florida law provides that the Governing Board for the Water Management Districts consist of members appointed by the Governor who reside in the respective Districts; and WHEREAS, those Governing Boards are delegated with substantial authority to directly influence local and regional interests including the expenditure of tax dollars assessed against landowners within those districts; and WHEREAS, the Board of County Commissioners after consideration of the above factors supports an amendment to the Florida Statute(s) creating the Florida Water Management Districts to provide for electing the Governing Boards rather than appointment of those members by the Governor; and NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, THAT: 1 , The Board hereby resolves and supports amending the Florida Statutes to require election of the Governing Boards of the Florida Water Management Districts.
