Dear Mr. Stevens
Please be advised that you are scheduled to appear before the Collier County Board of
Commissioners at the meeting of November 18, 2008 regarding the above referenced
subject.
Your petition to the Board of County Commissioners will be limited to ten minutes.
Please be advised that the Board will take no action on your petition at this meeting.
However, your petition may be placed on a future agenda for consideration at the
Board's discretion. If the subject matter is currently under litigation or is an on-going
Code Enforcement case, the Board will hear the item but will not discuss the item after it
has been presented. Therefore, your petition to the Board should be to advise them of
your concem and the need for action by the Board at a future meeting.
The meeting will begin at 9:00 a.m. in the Board's Chambers on the Third Floor of the W.
Harmon Tumer Building (Building "F") of the govemment complex. Please arrange to be
present at this meeting and to respond to inquiries by Board members.

I submitted a bid online for Collier County that I was low bidder on and not
awarded bElcause of a Local Vendor Preference Form that was not asked for
on the online submittal. I would have gladly filled in or attached the Local
Vendor Preference Form if there had been a place to attach it. I also believe
that it should have been automatically entered that way since J.D. Stevens,
Inc is registered with the County lI$ a local vendor, since 2003. (With both
Occupational & Contractor Licensing)
Please exolain in datail the action yOU are askina the Commission to take (attach

I think that since I was low bidder and local, I deserve the job, instead it hll$
become a negotiated contract.

I recently submitted a bid online for a Lime Sludge Hauling contract. I am low bidder and a local vendor but because of A Local
Vendor Preference Form (not asked for on my online submittal) I have been told the job will go to another company. Online it had
a place for three attachments. agreement for dump site. location of d~mp site, and permits il applicable. No other lorms were
asked for there, nor was there anywhere to attach additional Information. I am told that another company has filled out this lorm
and was within 10% of my price therefore was offered to match my price, costing me the job. The lorm was part of the paper bid
packet (along with other forms to sign), but not a part 01 or asked lor anywhere else on the online portion That to me is not
sealed bidding, but negotiated pricing between local bidders. I feel our system has la"ed us.

A form was attached to the bid It stated to claim local vendor preference you must fill out that form and submit it back Ydh
your bid. if you submit the form you will then be eligible to matcr, the lowest bidder if you are the next lowest and with In ten
percent II you submit the form and are the lowest bidder than you would be awarded. Your firm did not submit the lorm One of
the three bidders did submit and was next to the lowest and within the 10% thus they are allowed the opportunity to match the low
bid If they sign and agree to match then they are awarded the bid The entire process IS kicked off by the Local Vendor
Preference form It has to be submitted with you bids tc De eligible.

JD. Stevens is the low bidder but the nexl in line bidder has filed a local vendor preference form. Which mean IS they agree to
