EXECUTIVE SUMMARY
Recommendation for the Board of County Commissioners to approve the
award of Bid #08-5134 to the lowest qnaIified and responsive bidder
Williamson Brothers Marine Construction, Inc., for the constrnction contract
of the Caxambas Boat Dock Project #80057.1.
OBJECTIVE: That the Board of County Commissioners award Bid #08-5t34 to Williamson
Brothers Marine Construction, Inc. as the lowest most qualified responsive bidder for the
Caxambas Boat Dock Project.
CONSIDERATIONS: On Octoher 30, 2008, sealed bids were received at the purchasing
department for the construction of the Caxambas Boat Dock Project Bid #08-5134. The apparent
lowest and most responsive qualified bidder was Williamson Brothers Marine Construction, Inc.
Staff carefully evaluated each sealed bid with a unanimous determination to select WilJiamson
Brothers Marine Construction, Inc. as the lowest qualified bidder for the award of Bid #08-5134.
Staff reviewed the final bids for completeness and accuracy in view of the overall project scope
of work and proposed hudget and has concluded that Bid #08~5134 be awarded to Williamson
Brothers Marine Construction, Inc. consistent with the purchasing department policies and
procedures. Staff also performed a thorough background evaluation obtained from the
references provided, and determined that the reputation of the contractor satisfactorily adheres to
Collier County's set standards of professionalism and quality performance.

The bid tabulation is as follows: Tampa Bay Marine, Inc. ($207,193.70), Quality Enterprises,
USA. Inc. ($] 89.476.66), PBS. Inc. ($]86.195. t2l. Stemic Enterprises. Inc. ($186.064. t 7), Kelty
Brothers, Inc. ($168,756.75), and Jfilliamson Brothers Marine Construction, Inc., ($132,140.00),
Therefore, in consideration of the lowest and most responsive qualified bid staff recommends
that the bid be awarded to Williamson Brothers Marine Construction, Inc. as so noted. Please
note that Williamson Brothers Marine Construction, Inc. is not a local vendor, however, the local
vendor preference policy does not apply because the next highest bidder (Kelly Brothers, Inc.)
exceeds the 10% range provided in the policy for further consideration.
In addition to the above, this project will be partially funded by the City of Marco Island for the
installation of a Fire Rescue & Police Vessel Boat Lift & Dock to be installed at a predetermined
location on site under the terms and conditions of a recently executed Sublease Agreement file
#16D34 between the Board of County Commissioners and the City of Marco Island.
FISCAL IMPACT: The source of funding for this project has been previously allocated and
budgeted with FY 08-09 Capital Improvement Funds, Project #80057. t and will he partially
funded per agreement with the City of Marco Island.
GRO\\!TH MANAGEMENT IMPACT: This project is consistent with the objectives of 1.3
of the Growth Management Plan for improved boater access to waterways.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, and it does not present any legal issues. This item is not quasi judicial, and as
such ex parte disclosure is not required. This item requires majority vote only. This item is
legally sufficient for Board action. - CMG

Upon notification that its Bid has been awarded, the Successful Bidder will execute the
Agreement form attached to the Bidding Documents within ten (10) calendar days and
deliver the Surety Bond or Bonds and Insurance Certificates as required by the Contract
Documents. The bid security attached is to become the property of the Owner in the
event the Agreement, Insurance Certificates and Bonds are not executed and delivered
to Owner within the time above set forth, as liquidated damages, for the delay and
additional expense to the Owner, it being recognized that, since time is of the essence,
Owner will suffer financial loss if the Successful Bidder fails to execute and deliver to
Owner the required Agreement, Insurance Certificates and Bonds within the required
time period. In the event of such failure, the total amount of Owner's damages, will be
difficult, if not impossible, to definitely ascertain and quantify. It is hereby agreed that it
is appropriate and fair that Owner receive liquidated damages from the Successful
Bidder in the event it fails to execute and deliver the Agreement, Insurance Certificates,
and Bonds as required hereunder. The Successful Bidder hereby expressly waives and
relinquishes any right which it may have to seek to characterize the above noted
liquidated damages as a penalty. which the parties agree represents a fair and
reasonable estimate of Owner's actual damages at the time of bidding if the Successful
Bidder fails to execute and deliver the Agreement, Insurance Certificates, and Bonds in
a timely manner.
Upon receipt of the Notice of Award, the undersigned proposes to commence work at
the site within 5 calendar days from the commencement date stipulated in the written
Notice to Proceed unless the Project Manager, in writing, subsequently notifies the
Contractor of a modified (later) commencement date. The undersigned further agrees to
substantially complete all work covered by this Bid within ninety (90) consecutive
calendar days, computed by excluding the commencement date and including the last
day of such period, and to be fully completed to the point of final acceptance by the
Owner within thirty (30) consecutive calendar days after Substantial Completion,
