Agenda 12/16/2008 Item #16D 7 Agenda Item No. 16D7 December 16, 2008 Page 1 019 EXECUTIVE SUMMARY ~ Recommendation that the Board of County Commissioners approve and authorize the Chairman to sign a Consent of Mortgagee therehy allowing Eden Gardens Apartments Limited Partnership (EGALP) to execute a grant of easement to Lee County Electric Cooperative (LCEC) for the Reserve at Eden Gardens. OBJECTIVE: To provide approval for the Eden Gardens Apartment, Limited Partnership (EGALP) to execute a grant of easement to LCEC to proceed with electrical installation at the Reserve at Eden Gardens. CONSIDERATIONS: Collier County is currently providing a $442,000 State Housing Initiative Program (SHIP) loan to EGALP to assist in the total project funding for the Reserve at Eden Gardens. The Reserve at Eden Gardens, when completc, will provide fifty five (55) affordable, multi-family rental units for farm workers in the Immokalee area. To complete electrical work on these rental units, Lee County Electric Cooperative requires EGALP to execute a grant of easement. As a mortgage holder of the parcels on which the easements falls, Collier County's consent is required so electrical work can proceed and the project can be completed in a timely manner. Collier County's consent to the easements will not subordinate the County's interests in The Reserve at Eden Gardens. The United States Department of Agriculture (USDA), who is the first mortgage holder for this property, has already executed a Consent of Mortgagee. Further, the electrical work will provide a required benefit to the property. - FISCAL IMP ACT: None, no funding is required for this request. GROWTH MANAGEMENT IMPACT: This request is consistent with the Growth Management Plan. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office. This item is not quasi-judicial, and as such ex parte disclosure is not required. This itcm requires majority vote only.
