Agenda 12/16/2008 Item #16B 2 Agenda Item No, 1682 December 16, 2008 Page 1 of 36 EXECUTIVE SUMMARY Recommendation to approve the purchase of four (4) paratransit vehicles utilizing the FY08-09 Federal Transit Administration Section 5310 Grant award. OBJECTIVE: To obtain Board of County Commissioners' approval for the purchase of four (4) paratransit vehicles utilizing the FY08-09 Federal Transit Administration Section 5310 Grant award. CONSIDERATION: Collier County has been awarded a Federal Transit Administration (FTA) FY2008-2009 5310 grant to purchase four (4) replacement paratransit vehicles. The FTA 5310 Grant requires a 10% local match. On December 11, 2007, the BCC approved to accept the FT A FY2008-2009 5310 grant to purchase four vehicles, if awarded. On June 23, 2008 Collier County received a notice from the Florida Department of Transportation (FDOT) of a grant award determination for the purchase of four (4) paratransit vehicles. The County is required to write a purchase order equaling 10% of the total cost of the vehicles, The remaining 90% (80% Federal and 10% State) of the total costs for the vehicle are covered by purchase orders written by FDOT using the awarded FT A FY2008-2009 5310 grant money. - The Paratransit system maintains a capital replacement schedule for vehicles. The purchase of these vehicles will replace high mileage vehicles that have 200,000 to 250,000 miles and have been recommended and scheduled for replacement by Fleet Management. All four (4) vehicles were purchased in 2003, meet FTA vehicle end of useful life criteria, and are identified in the Vehicle Replacement Plan in the 2008 Transportation Disadvantaged Service Plan. The four (4) paratransit vehicles will be purchased through the FDOT Vehicle Procurement Program using a combination of FY08-09 FTA 5310 grant money and 10% local matching money. Each year the Florida Vehicle Procurement Program has assisted transit agencies in purchasing transit vehicles in the most economic way possible. This procurement program is managed by the FDOT and administered by the Center for Urban Transportation Research (CUTR). On March 29, 2008 Fleet held a Board of County Commissioners vehicle auction at which time (6) six paratransit vehicles were sold for $12,023,92 net proceeds, The $12,023.92 was deposited into Fund 427, In accordance with grant agreements made with Florida Department of Transportation to originally purchase these six sold vehicles, Collier County is obligated to reinvest any monies received in the disposal of these vehicles back into the grant program. By applying the $12,023.92 towards the 10% local matching money, the County fuliills this obligation and reduces our local match costs. ,-. FISCAL IMP ACT: The County match in the amount of $31,080 will be expended from Fund 427, Project 31427,\, Agenda Item No, 1682 December 16, 2008 Page 2 of 36 LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a majority vote for approval, and is otherwise legally sufficient for Board action.-SRT GROWTH MANAGEMENT IMPACT: Consistent with Objectives 10 and 12 of the Transportation Element of the Growth Management Plan. RECOMMENDATION: That the Collier County Board of Commissioners authorize the use of local money from Fund 427, Project 31427.1 in the amount of$31,080 for the purchase of four (4) paratransit vehicles from the FY 08-09 Florida Vehicle Procurement Program. CONSIDERATION: FTA funds, which are to be used for the purchase of para-transit vehicles to provide transportation services to the elderly and disabled residents of Collier County, are made available each year through an application process administered by the Florida Department of Transportation (FDOT). As a governmental entity, the BCC is eligible to file the grant application. This grant application seeks to maximize grant funding for the purchase of the four Para Transit vehicles scheduled for purchase in FY08. FISCAL IMPACT: The cost is estimated to be $310,800 for four (4) vehicles. If the grant request is approved, the source of funds will be $248,640 Federal, matched by $31,080 State and $31,080 local. The local share is budgeted in Fund 427 Transportation Disadvantaged operating budget in FY08. GROWTH MANAGEMENT IMPACT: Consistent with the Transportation Element of the Growth Management Plan as stated in Objectives 10 and 12, RECOMMENDATION: That the Board approve a Resolution authorizing the Chairman of the BCC to execute all documents necessary to apply for the Federal Transit Administration Section 5310 Grant, including executing the Certification and Assurance to FDOT document, a copy of which documents are attached hereto. It should be recognized that the grant award referenced above in the amount of $310,800 is a preliminary number and is subject to change. In approving this item, the BCC is providing authorization to approve all necessary budget amendments to receive and use these grant dollars including those incremental grant dollars received above or below the target grant award. By providing this latitude, the BCC is authorizing the County Manager to recognize by budget amendment actual grant revenue received currently and as may be adjusted in the future and align expenses accordingly. Services provided include fixed route bus service and paratransit service. The public transit services are managed by a contracted management company; McDonald Transit Associates, Inc. Paratransit service is available seven days per week, 24 hours per day, All service is provided by contracted operators. Paratransit service is door to door. Drivers will assist anyone who appears to need assistance, especially the frail and elderly and those who are mentally or physically disabled, from their door to their seat on the vehicle. Drivers will not go into a home and cannot go to rooms of nursing homes or hospitals due to time constraints and liability issues. Office hours are from 7:00 a,m, to 5:30 p.m, Monday through Friday. After hours calls are forwarded to one of the contracted carriers who have actual operations twenty-four hours per day. All available funds will be used to carry out the mission of the Collier County's Transportation Disadvantaged Local Coordinating Board, which is to carry out a coordinated and comprehensive approach to planning, developing and providing transportation services that meet the needs of transportation disadvantaged persons. It is estimated that over 100,000 one-way trips will be provided during the current fiscal year. Fares for the general public will be the same as other passenger fares. Fares for the paratransit program are implemented as regulated by each funding source. ADA fares are set up at $2,00 per one-way trip, lower than allowed by regulations and based on Collier Area Transit's fixed route bus fares. As mentioned above, service is managed by a contracted management company, McDonald Transit Associates, lnc, service is provided by carriers under contract to McDonald Transit using vehicles owned by thc County and hy the carriers. Collier Area Transit's fixed route operates nine routes, using 16 buses in peak service, Collier Area Transit's paratransit program operates up to 25 routes and or manifests each day; using an average of 15 Collier County owned vehicles. The balance of the routes are operated vehicles provided by private-for-profit providers. The maintenance of Collier County owned vehicles is performed by Collier County Fleet Management. Subcontractors are responsible for maintenance on privately owned vehicles, Collier Area paraTransit's program conducts regular safety inspections on subcontractor vehicles as a critical component of our overall safety and security program. Safety is a primary concern of all transportation entities, Our current vehicle inventory is supplied elsewhere in this grant application. As can be seen, many of the vehicles presently in the Collier County / Collier Area Transit Fleet have high mileage on them, As the Community Transportation Coordinator, we would like to be able to replace high mileage vehicles. State match funds in the amount of $31,080.00 (10%) will also be requested, This will be matched with local funds in the amount of $31,080.00. Funds from this grant will be used to purchase replacement vehicles to continue the existing level of service. The vehicles scheduled for replacement have exceeded their useful life and must be replaced if normal service is to continue. These and other vehicles will be used to provide paratransit transportation services throughout the county, The vehicles will be leased to providers under contract. Maintenance of these vehicles will be performed by the Collier County Management Department. Section 5310 funding for these vehicles is essential if service is to continue, Collier County currently provides over $1,000,000 each year to provide paratransit service. The current fleet of vehicles is inadequate due to their age and condition. If this grant is not approved, Collier County may be forced to use some of the Local Operating funds to purchase replacement vehicles. Collier Area Transit provides ADA, Medicaid, Transportation Disadvantaged, and agency funded paratransit trips for the at-risk population of Collier County, including those with disabilities, low income, or the elderly. Without 5310 funds for replacement vehicles, Collier County may have to implement the prioritization of Transportation Disadvantaged paratransit trips as allowed by the State of Florida Conunission for the Transportation Disadvantaged, outlined in Collier County's Transportation Disadvantaged Service Plan. Trips would be reduced and many passengers would not have access to recreational, medical, shopping and other life sustaining transportation. The Collier Countv BCC certifies and assures to the Florida Department of Transportation in regard to its Application for Assistance under V.S.C. Section 5310 dated December I L 2007: I) It shall adhere to all Certifications and Assurances made to the federal government in its Application. 2) It shall comply with Section 341.051 Florida Statutes and Chapter 14-73 Florida Administrative Code. 3) It has the fiscal and managerial capability and legal authority to file the application. 4) Local matching funds will be available to purchase vehicles/equipment at the time an order is placed, 5) It will carry adequate insurance to maintain, repair, or replace project vehicles/equipment in the event of loss or damage due to an accident or casualty. 6) It will maintain project vehicles/equipment in good working order for the useful life of the vehicles/equipment. 7) It will return project vehicles/equipment to the Department if, for any reason, they are no longer needed or used for the purpose intended, 8) It recognizes the Department's authority to remove vehicles/equipment from its premises, at no cost to the Department, if the Department determines the vehicles/equipment are not used for the purpose intended, improperly maintained, uninsured, or operated unsafely. 9) It will not enter into any lease of project vehicles/equipment or contract for transportation services with any third party without prior written approval of the Department. 10) It will notify the Department within 24 hours of any accident or casualty involving project vehicles/equipment, and submit related reports as required by the Department. 11) It will submit an annual financial audit report to the Department, if required by the Department.
