Agenda 12/16/2008 Item #16A13 EXECUTIVE SUMMARY Agenda Item No. 16A 13 December 16, 2008 Page 1 of 5 Recommendation to acknowledge those Lots along Ravenna Avenue, as shown on the attached Exhibits, as legal, non-conforming Lots of Record OBJECTIVE: To acknowledge the unnamed subdivision of Lots along Ravenna Avenue, located in Section 36, Township 48 South, Range 26 East, Collier County, as legal non- conforming Lots of Record. CONSIDERATIONS: 1. Engineering and Environmental Services Staff, Zoning and Land Development Review Department Staff, as well as the County Attorney's office have reviewed the associated documents and find that the best solution is to have the Board recognize the subject properties an legal, non-conforming Lots of Record. 2. The Lots were mapped out in their current configuration in 1972, a copy of the map survey is attached. 3. The Lots are generally 1.25 acres in size and the zoning for these Lots is Agricultural, which requires a minimum of 5 acres per unit. 4. Most of the Lots on Ravenna Avenue have received building permits on these Lots and the properties are occupied. 5. These properties are generally surrounded by other properties of similar size. FISCAL IMPACT: The County will realize revenues as follows: Revenue generated by this project: None, staff initiated request. GROWTH MANAGEMENT IMPACT: There is no growth management impact; these Lots have existed in their current form since the early 1970's. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the Resolution and associated legal documents for legal sufficiency. STW RECOMMENDATION: That the Board of County Commissioners acknowledge the Lots on Ravenna Avenue as shown on the attached Exhibits as legal, non-conforming Lots of Record. "I Agenda Item No. 16A 13 December 16, 2008 Page 4 of 5 RESOLUTION NO. 08-_ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA ACKNOWLEDGING THOSE LOTS ON RA VENNA A VENUE AND AS SHOWN ON THE ATTACHED EXHIBIT AS LEGAL. NON- CONFORMING LOTS OF RECORD WHEREAS. the Lots on Ravenna A venue were surveyed and mapped out in 1972; these Lots do not meet the minimum requirements for the Agricultural Zoning District which requires 5 acres minimum per Lot; the subject Lots are generally 1.25 acres in size; and WHEREAS, the Collier County Land Development Code defines a "Lot of Record" as any parcel which has been recorded in the public records or any parcel for which an agreement for deed was recorded prior to October 14, 1974 if said properties are located within the Coastal Area planning district; and WHEREAS, County Staff can not currently find any recorded documentation which would clearly establish these Lots as Legal Non-Conforming Lots of Record, although most of these Lots have received building permits over the years and are currently occupied; and WHEREAS, the Engineering and Environmental Services Section, as well as the Planning and Zoning Department of the Community Development Department have reviewed the properties and are recommending acknowledgment of the properties as Legal Non-Conforming Lots of Record. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board acknowledge the properties shown on the attached Exhibit as Legal Non-Conforming Lots of Record.
