Resolution 2001-017 11 A 1 RESOLUTION NO. 2001 ~ A RESOLUTION ~ESIGNATING THE CLERK Of CIRCUIT COURT AS THE REPRESENTATIVE Of COLLIER COUNTY TO BE THE PARTY RESPONSIBLE TO COLLECT COSTS AND fEES; TO COLLECT fiNES RESULTING fROM ACTIONS OF THE COURTS INURING TO THE BENEFIT OF THE POLITICAL SUBDIVISION OF COLLIER COUNTY. FLORIDA; TO DEFEND BOND FORFEITURES AND PROSECUTE CIVIL RESTITUTION LIENS; TO SETTLE THOSE CLAIMS IN THE BEST INTERESTS OF COLLIER COUNTY AND TO ALLOW THE COLLECTION OF A REASONABLE FEE FOR THE COLLECTION SERVICE AS PROVIDED BY LAW. WHEREAS, Chapter 125.17 of the Florida Statutes establishes that the Clerk of the Circuit Court is the Cle,rk to the Board of County Commissioners and may "perform such other duties as their clerk as the board may direct. "; and WHEREAS, by operation of law, ordinance and order, the Clerk of the Circuit Court has been granted authority to collect fines, costs and fees, the benefit of which inure to the political subdivision of Collier County and is the custodian of all the records and documents for the Board of Commissioners and the Courts; and WHEREAS, by operation of law, Collier County may defend bond forfeitures and may prosecute civil restitution liens; and WHEREAS, in Collier County, the Clerk of the Circuit Court collects the majority of all fines, costs and fees and as such has staff, personnel and procedures in place to accomplish these tasks efficiently and with minimal cost to the County; and WHEREAS, the citizens and taxpayers of Collier County, the Board of County Commissioners and the Florida Legislature recognize that public programs should have the costs of such programs supported by those who use the programs. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1 11 A 1 The Clerk of the Circuit Court of Collier County is hereby directed to be the party responsible to represent Collier County in the collection of costs and fees and in the collection of fines inuring to the benefit of Collier County, and may take all lawful actions to legally assert or defend the interests of Collier County in any and all actions involving criminal appearance bonds, collections of fines and costs imposed through Courts of this County and in assessment and collection of restitution liens; AND IT IS FURTHER RESOLVED that as representative of Collier County and the party responsible for collections, bond forfeitures and civil restitution liens, the Clerk of the Circuit Court is hereby authorized to use any lawful, cost efficient means to pursue or settle any such claim in the best interests of Collier County; AND IT IS FURTHER RESOLVED that the Clerk of the Circuit Court is hereby authorized to collect a reasonable fee necessary to fund the administrative costs of the services authorized by this resolution as provided by law.
