RESOLUTION NO. 200]-~
RESOLUTION FOR PETmON VAC 00-019 TO DISCLAIM, RENOUNCE AND
VACATE THE COUNTY'S AND THE PUBLIC'S INTEREST IN A PORTION OF A
ROAD RIGHT OF WAY FOR PELICAN STREET WHICH WAS DEDICATED TO
THE COUNTY BY THE PLAT OF "ISLES OF CAPRI NO. I", AS RECORDED IN
PLAT BOOK 3, PAGE 41, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
LOCATED IN SECTION 31, TOWNSHIP 51 SOUTH, RANGE 26 EAST.
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes, Douglas A. Wood, Esq. of
Siesky, Pilon & Wood, as agent for the petitioner, Samuel Hubschman, does hereby request the vacation of a
portion of the right of way for Pelican Street; and
WHEREAS, the Board has this day held a public hearing to consider vacating said Road Right of Way
as more fully described below, and notice of said public hearing to vacate was given as required by Jaw; and
WHEREAS, the granting of the vacation will not adversely affect the ownership or right of convenient
access of other property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that the following road right of way is hereby vacated:
See Exhibit "A" attached hereto and incorporated herein.
BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to advertise the
adoption of this Resolution once in a paper of general circulation in the County within 30 days following its
adoption.
BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to record a certified
copy of this Resolution, the proof of publication of the notice of public hearing and the proof of publication of
the notice of adoption of this Resolution in the Official Records of Collier County, Florida.
This Resolution adopted after motion, second and majority vote favoring same.
