WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioner, GBP Development, Ltd. has requested the vacation of the County's interest in two 15 foot wide drainage easements along the lot lines of Lot 7 & 8 and Lot 13 & 14 in Block "A" located in Fiddler's Creek Phase Four, Unit Two, as filed in Plat Book 45, pages 40-47 of the Public Records of Collier County, Florida situated in Section 11 and 14, Township 51 South, Range 51 East, being more specifically depicted and described in Exhibit 'A'; and WHEREAS, in conjunction with, and as part of Petitioner's request, Petitioner has offered for dedication three replacement drainage easement areas over Lots 6 & 7 and Lots 13 & 14 and Lot 22, also in Block "A" of Fiddler's Creek Phase 4, Unit 2 attached hereto and also being more specifically depicted and described in Exhibit "B", in the place of the vacated easements; and WHEREAS, the Board has this day held a public hearing to consider petitioner's request, and notice of said public hearing was given as required by law; and WHEREAS, the granting of the Petitioner's request will not adversely affect the ownership or right of convenient access of the property owners; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in the two 15 foot wide drainage easements as specifically depicted and described in Exhibit 'A' is hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be in the Public's interest and for the Public's benefit. 17A'" BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby directed to record a certified copy of this Resolution in the Official Records of Collier County, Florida at that time the requirements of this Resolution are fulfilled, and to make proper notation of this vacation on the recorded plat as referenced above.
