RENAMING A SEGMENT OF GREEN BOULEVARD TO
MARBELLA LAKES DRNE, WHICH STREET SEGMENT IS
LOCATED BETWEEN LIVINGSTON ROAD AND
WHIPPOORWILL LANE IN TRACTS A-2 AND A-3A OF THE
MARBELLA LAKES SUBDIVISION WHICH IS IN SECflON
19, TOWNSHIP 49 SOUTH, RANGE 26 EAST. COLLIER
COUNTY, FLORIDA; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the legislature of the State of Florida by enacting ~ 336.05, FlOrida Statutes,
has conferred on all counties in Florida the power to name or rename streets and roads, except for
certain state roads; and
\\'HEREAS, Collier County pursuant thereto has adopted Collier County Ordinance No.
07-62, as codified in Chapter 22, Article X, of the Collier County Code of Laws and Ordinances,
which establjshes criteria and procedures to rename streets or roads; and
WHER EAS, the Collier County Board of County Commissioners (Board) has held a
public hearing after providing notice as required by said ordinance and has considered the
advisability of granting the request by William M. Fenno on behalf of Maxbclla Lakes
Associates, LLC, to rename a segment of Green Boulevard to Marbella Lakes Drive. lbisstreet
segment is located between Livingston Road and Whippoorwill Lane in Tracts A-2 and A-3A of
the Marbclla Lakes Subdivision., according to the plat thereof, recorded in Plat Book 46, Pages
17 through 83, of the Official Records of Collier County, Florida, which is in Section 19,
Township 49 South, Range 26 East, Collier County, Florida; and
WHEREAS, the Board has determined that all criteria set forth in Ordinance No. 07-62
have been met and specifically finds that there is no other street in incorporated or
unincorporated Collier County with this name or any similar sounding name as is being
requested; and
\VHEREAS, the Board has determined that it is necessary for identification purposes to
confirm the name of this street.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMI..C;;SIONERS OF COLLIER COUNTY, FLORIDA. that:
Effective this date, the name of the street segment described in the above recitals is
hereby changed from Green Boulevard to MarbeUa Lakes Drive, and is confirmed as such.
BE IT FURTHER RESOLVED that if and when Green Boulevard is extended westward
from Santa Barbara Boulevard to Marbella Lakes Drive, the County shall be entitled to rename
Marbella Lakes Drive to Green Boulevard without the consent of the property owner or
homeowners association.
BE IT FURTHER RESOLVED that this Resolution be recorded in the Public Records of
Collier County, Florida, and noted upon the maps of the street and zoning atlases of Collier
County, and noUltions made on the referenced Plat.
This Resolution adopted after motion, second and super majority vote this _day of

meeting will begin at 9:00 A.M. The title of the proposed resolution

in Plat Book 46, Pages 77 through 83, of the Official Records of
Collier County, Florida, which is in Section 19, Township 49, Range
26, Collier County, Florida.
NOTE: All Persons wishing to speak on any agenda item must register
with the County Administrator prior to presentation of the agenda
item to be addressed. Individual speakers will be limited to 5
minutes on any item. The selection of an individual to speak on
behalf of an organization or group is encouraged. If recognized by
the Chair, a spokesperson for a group or organization may be allotted
10 minutes to speak on an item.
Persons wishing to have written or graphic materials included in the
Board agenda packets must submit said material a minimum of 3 weeks
prior to the respective public hearing. In any case, written
materials intended to be considered by the Board shall be submitted
to the appropriate County staff a minimum of seven days prior to the
public hearing. All material used in presentations before the Board
will become a permanent part of the record.
Any person who decides to appeal a decision of the Board will need a
record of the proceedings pertaining thereto and therefore, may need
to ensure that a verbatim record of the proceedings is made, which
record includes the testimony and evidence upon which the appeal is
based.

WHEREAS, the legislature of the State of Florida by enacting S 336.05, Florida Statutes,
has conferred on all counties in Florida the power to name or rename streets and roads, except for
certain state roads; and
WHEREAS, Collier County pursuant thereto has adopted Collier County Ordinance No.
07-62, as codified in Chapter 22, Article X, of the Collier County Code of Laws and Ordinances,
which establishes criteria and procedures to rename streets or roads; and
WHEREAS, the Collier County Board of County Commissioners (Board) has held a
public hearing after providing notice as required by said ordinance and has considered the
advisability of granting the request by William M. Fenno on behalf of developer, Marbella Lakes
Associates, LLC, to rename a segment of Green Boulevard to Marbella Lakes Drive. This street
segment is located between Livingston Road and Whippoorwill Lane in Tracts A-2 and A-3A of
the Marbella Lakes Subdivision, according to the plat thereof, recorded in Plat Book 46, Pages
77 through 83, of the Official Records of Collier County, Florida, which is in Section 19,
Township 49 South, Range 26 East, Collier County, Florida; and
WHEREAS, the Board has determined that all criteria set forth in Ordinance No. 07-62
have been met and specifically finds that there is no other street in incorporated or
unincorporated Collier County with this name or any similar sounding name as is being
requested; and
WHEREAS. the Board has determined that it is necessary for identification purposes to
confirm the name of this street.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Effective this date, the name of the street segment described in the above recitals is
hereby changed from Green Boulevard to Marbella Lakes Drive, and is confirmed as such.
BE IT FURTHER RESOLVED that if and when Green Boulevard is extended westward
from Santa Barbara Boulevard to Marbella Lakes Drive or Whippoorwill Road is extended south
to Marbella Lakes Drive, the County may rename Marbella Lakes Drive pursuant to the
applicable provisions of the County Codes of Laws and Ordinances or other such regulations that
may be in effect at the time of the County's application to rename the street at the expense of
developer, or its successors or assigns.
BE IT FURTHER RESOLVED that this Resolution be recorded in the Public Records of
Collier County, Florida, and noted upon the maps of the street and zoning atlases of Collier
County, and notations made on the referenced Plat.
This Resolution adopted after motion, second and super majority vote this cQ8~~ day of
