OBJECTIVE: To adopt a resolution vacating a 5 foot wide Utility Easement along the southwesterly line of Site #57, Pelican Bay' Unit Ten, according to the Plat thereof as recorded in Plat Book 15, Pages 64 through 67, inclusive, of the Public Records of Collier County, Florida, situated partly in Section 33, Township 48 South, Range 25 East and partly in Section 4, Township 49 South, Range 25 East, Collier County, Florida, and being more specifically described in Exhibit "A ". CONSIDERATIONS: Petition AVPLAT- PL2009 -651, has been received by the Engineering and Environmental Services Department from Carrie E. Lademan of Woodward, Pires & Lombardo, P.A. as agents for Anne D. Rubin, property owner, requesting the vacation of the 5foot wide utility easement along the southwesterly lot line. The owner purchased the property unaware that the existing building encroached upon the platted utility easement. Since letters of no objection have been received from applicable utility companies' and other divisions and entities, staff recommends the vacation of the easement. FISCAL IMPACT: Engineering and Environmental Services Department staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. ENVIRONMENTAL ISSUES: There are no outstanding environmental issues. HISTORICAL /ARCHAEOLOGICAL IMPACT: There are no historical or archaeological impacts. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the Resolution and associated legal documents. This item is quasi - judicial, requires a simple majority vote, and ex parte disclosures are required.
