RESOLUTION NO. 2002- BL
RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE CORRECTIVE
DECLARA TION OF A UTILITY EASEMENT.
WHEREAS, Collier County is desirous of encumbering property currently
owned by the County with a utility easement described in Exhibit "A", attached hereto
and made a part hereof; and
WHEREAS, the described easement is a necessary element required for
installation and maintenance of utility infrastructure for well-sites and pipelines leading
to and serviced by the North County Regional Water Treatment Plant; and
WHEREAS, the easement will allow Collier County to proceed with expansion
of the necessary well-sites in a timely fashion; and
WHEREAS, the previously authorized and recorded Declaration of Easement
(O.R. Book 3039, Page 272) contained an incorrect legal description and the attached
instrument corrects that error by replacing the previously recorded Declaration of
Easement in its entirety.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners of Collier County, Florida, hereby approves
the Corrective Declaration of Easement described in Exhibit "A" and authorizes
its execution and recording in the Public Records of Collier County, Florida.
2. This Resolution shall take effect immediately upon adoption.
