Resolution 2002-290 RESOLUTION 2002-~ 0 16A27 A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, PURSUANT TO SECTION 2.7.3.4 OF THE COLLIER COUNTY LAND DEVELOPMENT CODE AFFECTING ORDINANCE 93-92 ALSO KNOWN AS "SUNSHINE VILLAGE" PUD, REQUIRING THE SUBMITTAL OF A PUD AMENDMENT; AND PROVIDING AN EFFECTIVE DATE. RECITALS WHEREAS, the "Sunshine Village" PUD, Ordinance 93-92 adopted on December 21, 1993, is subject to the provisions of Section 2.7.3.4., of the Land Development Code (LDC), Time Limits for Approved PUD Master Plans as such regulations existed on October 23, 2001; and WHEREAS, the Board of County Commissioners has reviewed the PUD and has deter- mined that the development authorized by the current PUD Master Plan has not commenced; and WHEREAS, staff has also reviewed the subject PUD Zoning and determined that said zoning does not appear to be entirely consistent with certain provisions of the Growth Management Plan (GMP) and the Land Development Code (LDC). NOW, THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Collier County, Florida that: 1. The above Recitals are adopted by reference as if fully set forth herein. 2. This Resolution constitutes evidence of the County staffs compliance with the review requirements of Section 2.7.3.4, of the LDC. 3. Pursuant to that section of the WC, the property owner or agent is now required by this Resolution to submit an amended PUD to the Planning Services Director prior to November 26, 2002 in order to cause said PUD to become consistent with the Collier County LDC and GMP. BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this Board and in the records of the Petition for which the extension is granted. -1- This Resolution is effective immediately upon its approval. 16A27 This Resolution adopted after motion, second and majority vote.
