Agenda 07/09/2019 Item #16C 8 (FPL Solar Lease Agreement Amendment)07/09/2019 EXECUTIVE SUMMARY Recommendation to authorize execution for the First Amendment to the Solar Lease Agreement with the Florida Power & Light Company (FPL) for the Collier County Sports Complex and Events Center (CC-SCEC). OBJECTIVE: To have FPL install and maintain solar power generating equipment at CC-SCEC, providing 2 Solar Trees and 1 Canopy for the trophy section in the park. CONSIDERATIONS: FPL SolarNow is a way for FPL customers to participate in a voluntary program that supports the development of solar energy projects in local communities. Community solar projects, like solar trees and canopies, are constructed in local public areas such as parks, zoos, and museums. FPL installs, operates, and maintains these projects which generate clean, r enewable energy at no cost to the County. The lease states that FPL shall be granted the use of the premises at the park to construct a solar canopy structure in the park’s trophy section. Installation, operation, maintenance, repair, and replacement co sts of any equipment will be borne by FPL. The lease includes an annual rent payment to be calculated based on the actual capacity of kilowatts of solar power installed by FPL multiplied by twenty dollars ($20.00) per kilowatt. The installation of solar equipment is consistent with the County’s education mission and will promote the benefits of solar energy to the people who will visit the facility. The solar installation will also provide CC-SCEC visitors with shaded areas around the trophy section in the park. There is no cost associated with the 25-kw installation of the two trees and canopy. The term of the lease includes a construction term (12 months with option for a 12 -month extension) and operating term of five years allowing FPL the option to renew for two more five-year terms. Either party may terminate the lease with a 30 day notice to the other party; however, if County terminates within the first 15 years of the lease, County is required to pay FPL an amount equal to the actual costs incurred for removal and disposal or relocation costs of the equipment, and repair and restoration of the premises. FISCAL IMPACT: Annual rent revenue of approximately $500 ($20/kwh) for the lease term, will be deposited into Sports Complex Fund (759) cost center 101555. GROWTH MANAGEMENT IMPACT: There is no growth management impact. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires and majority vote for Board action. - JAB RECOMMENDATION: To approve and authorize the Chair to execute Amendment to the Solar Lease Agreement and direct the County Manager (or designee) to follow all appropriate procedures for delivery of the document to Florida Power & Light Company.
