EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement (Agreement) for Lot 88, Imperial Golf
Estates Phase IV, according to the plat thereof as recorded at Plat Book 13, Pages 104 -106 of the
Public Records of Collier County.

OBJECTIVE: To approve an Easement Use Agreement between the County, and the current property
owner of Lot 88, Imperial Golf Estates Phase IV, and the Imperial Golf Estates Homeowner’s
Association, Inc.
CONSIDERATIONS: The property is located at 2016 Imperial Golf Course Boulevard. There is an
existing pool screen enclosure on the subject property that encroaches 2.8 feet into a 12-foot Drainage
Easement. The current owner purchased the property with the encroachment in place. The subject
easement is dedicated to Collier County with no responsibility for maintenance, according to the plat.
The Imperial Golf Estates Homeowner’s Association maintains the easement area. There are no drainage
facilities within the easement, just a small swale. Development Review has reviewed the Agreement and
Exhibits and recommends approval of the Easement Use Agreement. The County’s Stormwater Program
has indicated that they have no objection to the encroachment.
FISCAL IMPACT: There is no fiscal impact. The property owner will be responsible for the recording
fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. SAA
RECOMMENDATIONS:
1. To approve the Easement Use Agreement between the County, Imperial Golf Estates Homeowner’s
Association, and the current property owner of Lot 88, Imperial Golf Estates, Phase IV, and authorize
the Chairman to execute the Agreement.
2. Direct the Clerk to record the Easement Use Agreement.
