Agenda 06/25/2019 Item #17F (Fiddler's Creed CDD External Boundaries)06/25/2019 EXECUTIVE SUMMARY Recommendation to adopt an ordinance amending Ordinance No. 17-16, as amended, to amend the external boundaries of the Fiddler’s Creek Community Development District #2, by contraction of 210.003± acres, pursuant to Chapter 190.046, Florida Statutes. OBJECTIVE: That the Board of County Commissioners (Board) approve the Petition submitted to the County by Taylor Morrison of Florida, Inc., a Florida for profit corporation, by adopting an ordinance amending Ordinance No. 17-16, as amended, decreasing the size of acreage by 210.003± acres. CONSIDERATIONS: The existing District is located entirely within Collier County, Florida. The property for the Fiddler’s Creek Community Development District #2 is designated, Urban Mixed-Use District, Urban Coastal Fringe Subdistrict, per the Future Land Use Map of the Future Land Use Element. The site is located in portions of Sections 11, 13, and 14, Township 51 South, Range 26 East, and Section 18, Township 51 South, Range 27 East. On November 19, 2002 the Fiddler’s Creek Community Development District #2 was established by Ordinance No. 02-61, initially comprised of 998.79± acres. On June 24, 2014, the Board adopted Ordinance No. 14-26 to expand the acreage of District #2 by an additional 69.30± acres, bringing the CDD #2 total up to 1,068.09± acres. On May 9, 2017, the Board adopted Ordinance #17 -16 to decrease the acreage of District #2 by 8.36± acres, bringing the total down to 1,059.73± acres. This petition seeks to amend the Fiddler’s Creek Community Development District #2 boundaries to remove the contraction area, the total acres of the contraction is 210.003± acres. A mandatory $1,500 application fee was submitted with the amendment petition. A sketch of legal description referencing the general location of the existing District #2 is provided in the Petition’s Exhibit “1” and attached hereto as Attachment “1”. A sketch of the CDD parcel of the contraction area provided in the petition metes and bounds description within Exhibit “2”, i s attached hereto as Attachment “2”. After contraction, the District will encompass approximately 849.73± acres. FISCAL IMPACT: There is no fiscal impact on the tax payers of Collier County. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. TO AMEND THE BOI.INDARIES OF FIDDLER'S CREEK COMMLTNITY DEVELOPMENT DISTRICT #2, THROUGH CONTRACTION PETITION TO AMEND THE FIDDLER'S CREEK COMMUNITY DEVELOPMENT DISTRICT #2 Petitioner, Taylor Morrison of Florida, Inc., a Florida for profit corporation ("Petitioner"), hereby submits this Petition to the Board of County Commissioners of Collier County, Florida, pursuant to the Uniform Community Development District Act of 1980, Chapter 190, Florida Statutes, to amend the Fiddler's Creek Community Development District #2 ("District") to remove 210.003 acres ofland as described herein. In support of this Petition, Petitioner states as follows: 1. Location and Size. The District is located within Collier County, Florida. Exhibit "1" depicts the general location of the existing District. The District currently contains approximately 1059.73 acres and as a result of this amendment will contain 849.73 acres. The metes and bounds description of the contraction area is set forth in Exhibit "2". 2. The District has reviewed the Contraction Area and determined that it is in the best interest of the District to amend its boundaries to remove the Contraction Area As the total acres of the contraction is 210.003 acres, the amendment will not result in a cumulative net total greater than 50 percent of the District's initial acreage and will not be greater than 1000 acres on a cumulative net basis. Therefore, the boundary change from taking out the Contraction Areas do not exceed the acreage requirements ol Section 190.046(1)(e)1 (as amended by Chapter 2016-94, Laws of Florida), Florida Statutes, and the Petition may be reviewed under Section 190.046(l)(e), Florida Statutes. 1 17.F.2 Packet Pg. 2996 Attachment: Fiddler's Creek CDD #2 Petition (8867 : Fiddler's District #2 Amendment) 3. After the contraction, the District will encompass approximately 849.73 acres. The metes and bounds description of the District, as amended to effect the net contraction, is set forth in Exhibit "3". 5. Future Land Uses. Contraction of the District in this manner is not inconsistent with and is consistent affirmatively with the adopted Collier County Comprehensive Plan ("Plan"). The designation of future general distribution, location, and extent of the public and private land uses of land proposed for the land in both the Contraction Area by the future land use plan elements ofthe Plan are: a. For the land in the Contraction Area, there are no designated future general distribution, location and extent ofthe public uses of the land in the Plan and the designated general distribution, location and extent of the private uses of the land are urban residential; 6. The District provides, and has provided, no services to the Contraction Areas 7. Statement fE tim . The statement of estimated re gulatory costs ("SERC") prepared in accordance with the requirements of Section 120.541, Florida Statutes is set forth in Exhibit "5". The SERC is based upon presently available data. The data and methodology used in the preparing the SERC accompany it. 2 4. Landowner Consent. Pursuant to Section 190.046(1Xg), Florida Statues, Petitioner has identified and obtained wdtten consent to amend the boundaries of the District from one hundred percent of the landowners of the Contraction Area. The Petitioner has submitted the Petition and the requisite $ 1,500 filing fee in conjunction with this Petition of Collier County. 9. Reasons for the Contraction A end ments Per Each Land Area. The reasons for the boundary contractions is: a. Undeveloped land is to be removed from the District and integrated into a new development section of Fiddler's Creek currently not part of any community development district so that landowners within the District will not have to pay for infrastructure to serve this undeveloped land. Further, the petitioner is interested in making the boundary changes to facilitate the more efficient delivery of service consistent with sound facilities planning. The contracted area may be combined with approximately 516.275 acres and a new Community Development District may be formed. 10. The Petitioner respectfully asserts the Petition to Amend the Fiddler's Creek Community Development District #2 should be $anted for the following reasons: a. All statements contained in the Petition are true and correct. b. Amendment of the District and all land uses and services planned within the District, as amended, are not inconsistent with applicable elements or portions of the adopted State Comprehensive Plan or the Collier County Comprehensive Plan. c. The land within the District will continue to be of sufficient size and sufficiently compact and contiguous to be developed as one functional and interrelated community. d. The net contraction of the District is so that the District may deliver infrastructure systems, facilities and services more efficiently, consistent with sound facility planning. Thus, the District continues to be the best altemative available for delivering community development services and facilities to the area that will be served bv the District. The District's community development services and facilities, as amended, will continue not to be incompatible with the capacity and use of existing local and regional community development services and facilities. f. The District encompasses 1059.73 acres of land, more or less, and is contracting it's boundaries by 210.003 acres of land, more of less, all of which is located within Collier County, Florida. The limitations on the scope of this SERC are explicitly set out in Section 190.045 F.S. (governing termination, contraction, or expansion of district) as follows: "Pursuant to Section 190.0a6(1)(a) the petitioner is required to prepare among other items a SERC for the contraction of the bou ndaries, however, it should be pointed out that most of the provisions of a SERC are not applicable for a contraction of any District. ln this instance, there is a companion item that is coming before the Board of County Commissione/s to establish the Estancia Community Development District and which addresses all of the elements of the Statement of Regulatory Requirements for the property within the proposed Estancia Community Development District, and which are being removed from the Fiddler's Creek Community Development District #2. 1.2 Overview of the Development and the District A Community Development District ("CDD") is an independent unit of special purpose local government created and chartered by Chapter 190, Florida Statutes, to plan, finance, construct, operate and maintain community-wide infrastructure in large, planned community developments. lt may be established on the proposed property by ordinance and this SERC is related only to the petition to establish. CDD'S provide a "solution to the state's planning, management and financing needs for delivery of capital infrastructure to service projected growth without overburdening other governments and their taxpayers." Section 190.002(1)(a), F.S. A CDD is not a substitute for the local, general purpose, government unit, i.e., the County in which the CDD lies. Their will not be any increases in regulatory costs, principally dealing with transactional costs as a result of imposition of special assessments since the area subject to this petition is being contracted from the Fiddler's Creek Community Development District #2. Next, the sole reason for the establishment of any District is to provide public facilities and services to support the development of the Community. The existing Fiddler's Creek Community Development District #2 currently promotes local economic activity, creates local value, leads to local private sector investment and is likely, at least in the short term, to support local private sector employment and/or lead to local new job creation. This petition, however, contracts the Fiddler's Creek Community Development District f2, and these elements are not applicable to the Fiddle/s Creek Community Development District S2. The Fiddler's Creek Community 0evelopment District s2 currently plans, funds, implements, operates and maintains, for the benefit of the landowners within the District, various public facilities and services necessary for the continued development of the community. Such facilities and services, allow for the development of the land within the District for private use and the contraction of the boundaries of the District will not interfere with this purpose. The Fiddler's Creek Community Development District #2 has used proceeds of indebtedness to fund construction of public infrastructure, which has been constructed by private firms, and uses private firms to operate and maintain such infrastructure/provide services to the landowners and residents of the Fiddler's Creek Community Development District #2, and the contraction of the Fiddler's Creek Community Development District s2, does not deter this process from continuing this course. While similar economic growth, private sector job creation or employment, or private sector investment could be achieved in the absence of the District by the private sector alone; the 4l 17.F.8 Packet Pg. 3028 Attachment: Exhibit 5 Statement of Regulatory Costs (8867 : Fiddler's District #2 Amendment) 3.3 question: 3.3.1 3.4 Response: 3.4.1 3.5 Question: 3.5.1 JP Wzd and Associ2tes LLC contraction of the Fiddler's Creek Community Development District #2 does not deter the private sector from continuing this process. When assessing the question of whether the contraction of the Fiddler's Creek Community Development District $2 is likely to directly or indirectly have an adverse impact on business com petitive ness, including the ability of persons doing business in the state to compete with persons doing business in other states or domestic markets, productivity, or innovation, one has to compare these factors in the presence and in the absence of the Fiddler's Creek Community Development District #2 in the development. When the question is phrased in this manner, it can be surmised that the Fiddler's Creek Community Development District fl2 is likely to not have a direct or indirect adverse impact on business com pet itiveness, productivity, or innovation versus that same development without the District. Likelihood on an increase in regulatory costs, including any transactional costs, in excess of S1 million in the aggregate within 5 years after the implementation of the rule. The contraction of the Fiddle/s Creek Community Development District S2 will not increase any regulatory costs of the State or the County. A one-time filing fee to Collier County for the contraction to offset any expenses that the County may incur in the processing of this petition. Similarly, the Fiddler's Creek Community Development District #2 will continue to be required to pay the annual Special District Filing Fee, for the remaining land in the Fiddler's Creek Community Development District #2 which fee is meant to offset any State costs related to its oversight of all special districts in the State. The contraction of the Fiddler's Creek Community Development District #2 will, however, not directly increase regulatory costs to the existing landowners within the District. A good faith estimate of the number of individuals and entities likely to be required to comply with the ordinance, together with a general sl 17.F.8 Packet Pg. 3029 Attachment: Exhibit 5 Statement of Regulatory Costs (8867 : Fiddler's District #2 Amendment) JP Watd end Associates LLC description of the types of individuals likely to be affected by the ordinance. 3.6 Response: The contraction of the Fiddler's Creek Community Development District #2 changes the size of the Fiddler's Creek Community Development District #2 by removing 210.003 acres of land. 3.7 Question: 3.7.L A good faith estimate of the cost to the agency, and to any other state and local government entities, of implementing and enforcing the proposed rule, and any anticipated effect on state or local revenues. 3.8 Response: 3.8.1 There is no state agency promulgating any rule relating to this project that is anticipated to effect state or local revenues. ln this regard it is important to note that any debt obligations incurred by the District to construct its infrastructure, or for any other reason, are not debts of the State of Florida, the County, or any other unit of local government. ln accordance with State law, debts of the District are strictly its own responsibility. 3.9 Question: 3.9.1 A good faith estimate of the transactional costs likely to be incurred by individuals and entities, including local government entities, required to comply with the requirements of the rule. Local Government: (Collier Cou nty) The proposed land for contraction is wholy within Collier County, Florida. Collier County and its staff may process, analyze, conduct a public hearing, and vote upon the petition to contract the Fiddle/s Creek Community Development District'Kenneth Baer' <kbaer@thepointeatmiddleriver.org> #2. These activities will absorb some resources. The costs to review the record of the local hearing, the transcript of the hearing, and the ordinance adopted by the local general-purpose government will be offset by the filing fee required under 190.005 (1), F.S. These costs to Collier County are modest for a number of reasons. First, according to Chapter 190, F.S., review of the Petition to contract the District does not include analysis of any community developments within the boundaries of the District. Second, the Petition itself provides much of the information needed for a staff review. Third, local governments already possess the staff needed to conduct the review without the need for new staff. Fourth, there is no capital required to review the Petition. Fifth, the potential costs are offset by the required filing fee. Finally, general purpose local Bovernments routinely process petitions for land uses and zoning changes that are far more complex than is the Petition to establish a Community Development District.
