Agenda 06/25/2019 Item #16D12 (SHIP & LHAP 3yr Plan)06/25/2019 EXECUTIVE SUMMARY Recommendation to adopt by Resolution the revised State Housing Initiatives Partnership Program Local Housing Assistance Plan for Fiscal Years 2019-2020, 2020-2021, and 2021-2022 and authorize submission to the Florida Housing Finance Corporation. OBJECTIVE: To approve the State Housing Initiatives Partnership (SHIP) Program 2019-2020, 2020- 2021 and 2021-2022 Local Housing Assistance Plan (LHAP), as required triennially, setting forth the program operations for this 3-year period. CONSIDERATIONS: On July 7, 1992, the Florida legislature signed into law the Sadowski Affordable Housing Act to provide additional funding to local jurisdictions through a documentary stamp tax on real estate transactions for the provision of affordable housing. Through the Florida Housing Finance Corporation (FHFC) SHIP Program, Collier County and the City of Naples receive funds to undertake eligible activities as provided by Section 420.9075, F.S. and Chapter 67-377, F.A.C. These funds are for the provision of affordable housing. Pursuant to Section 420.9075, F.S. and Chapter 67-375(1), F.A.C., Collier County must adopt an LHAP every three (3) years and submit it to the grantor agency (FHFC) to continue receiving SHIP funds from the documentary surtax collections. It is required that a minimum of sixty-five percent (65%) of SHIP funds be spent on homeownership activities and seventy-five (75%) of all funds must be spent on construction activities. Construction includes rehabilitation undertaken on a home receiving SHIP assistance. There are eight (8) strategies in the new LHAP designed to meet the statutory requirements and address community needs as follows: 1. Owner Occupied Rehabilitation 2. Purchase Assistance 3. Disaster Mitigation 4. Rental Development 5. Rental Rehabilitation 6. Rental Acquisition 7. New Construction Assistance 8. Demolition & Replacement of Manufactured Homes On April 23, 2019, the Board of County Commissioners (Board) approved the LHAP as Agenda Item #16D1. The approved document was submitted to FHFC as the grantor agency. The grantor agency requested some minor modifications to the LHAP to simplify the language and include technical revisions as follows: • Reduce the amount of project delivery cost; previously ten percent (10%); FHFC reduced to five percent (5%) • Include any relocation expenses in the maximum award amount • Remove the land acquisition strategy • Relocate the County’s citizenship and asset cap requirements to each applicable strategy The identified changes were completed and resubmitted to FHFC on May 3rd for their committee review on May 30, 2019. From time to time, FHFC may release Technical Bulletins regarding clarification/modification to the 3-year LHAP. There may be future technical changes of a minor nature that staff will need to make and submit to FHFC in a timely manner, without bringing technical changes to the Board. All future amendments will be done in compliance with Chapter 67-376. Amendments that 16.D.12 Packet Pg. 2037 06/25/2019 do not add, delete, or significantly alter a strategy are considered technical and not subject to the FHFC amendment review process. FISCAL IMPACT: Submission of the LHAP allows Collier County to be eligible to receive SHIP funding. SHIP funds are deposited in SHIP Grant Fund (791). GROWTH MANAGEMENT IMPACT: The SHIP LHAP facilitates efforts to meet the goals, objectives, and policies set forth in the Housing Element of the Growth Management Plan. LEGAL CONSIDERATIONS: The proposed LHAP meets the requirements of Part VII of Chapter 420, Florida Statutes.
