Agenda 06/25/2019 Item #16A11 (Orange Blossom Dr-Drainage & Utility Easement)06/25/2019 EXECUTIVE SUMMARY Recommendation to approve an easement agreement for the purchase of a Road Right-of-Way, Drainage and Utility Easement (Parcel 124RDUE2) required for the widening of Orange Blossom Drive, east of Airport-Pulling Road (Project 60211). OBJECTIVE: To obtain a perpetual non-exclusive Road Right-of-Way, Drainage and Utility easement for the future Orange Blossom Drive widening project (the Project). CONSIDERATIONS: Collier County is seeking to purchase a 1.295-acre, perpetual, non-exclusive Road Right-of-way, Drainage and Utility Easement (“Parcel 124RDUE2”) for the expansion of Orange Blossom Drive. Parcel 124RDUE2 is part of a 29.28 acres parent tract owned by Siena Lakes, LLC (“Owner”). The parent tract is located on the north side of Orange Blossom Drive and east of Airport- Pulling Road. The Siena Lakes CCRC Commercial Planned Unit Development (CPUD), Ordinance No. 09-65, as amended by Ordinance No. 09-65, requires that the Owner convey Parcel 124RDUE2 to the County in exchange for a negotiated value not to exceed $150,000. ROW staff have investigated the current market value of the parent tract (see attached memo); the underlying value of Parcel 124RDUE2 far exceeds the $150,000 cap. The attached agreement accordingly provides for a purchase price of $150,000 to be paid by the issuance of Road Impact Fee credits, which the Owner has requested. Recording fees and other costs related to the closing will be paid by the Owner. The Road Impact Fee credits granted for the Development shall not be assigned or otherwise transferred to another development except as provided for in the Collier County Consolidated Impact Fee Ordinance. The credit for the Road Impact Fee shall run with the Development and shall be reduced by the entire amount of each Road Impact Fee due for each building permit issued thereon until the Development is either completed or the credits are exhausted or otherwise no longer available. FISCAL IMPACT: Road Impact Fee credits in the amount of $150,000 will be issued in exchange for Parcel 124RDUE2. The primary funding source for the acquisition of right-of-way is impact fees. The developer will be responsible for paying all closing costs, title search fees and recording fees. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. RECOMMENDATION: . Approve the attached easement agreement and authorize the Chairman to execute same on behalf of the Board; . Accept the conveyance of Parcel 124RDUE2 and authorize the County Manager, or his designee, to record the conveyance instrument in the public records of Collier County, Florida; . Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the easement agreement to close the transaction, including the issuance of Road Impact Fee credits; 16.A.11 Packet Pg. 1257 06/25/2019 . Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the easement agreement; and . Authorize any, and all, budget amendments that may be required to carry out the collective will of the Board.
