Agenda 06/25/2019 Item #16A 4 (Madison Park-Water Main Extension)06/25/2019 EXECUTIVE SUMMARY Recommendation to approve final acceptance and accept the conveyance of the potable water and sewer utility facilities for Madison Park Phase 1, PL20130000921, and Madison Park Phase A Water Main Extension, PL20140001339. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water-Sewer District, approve final acceptance and accept the conveyance of these potable water and sewer facilities, in accordance with the Collier County Utilit y Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of Madison Park Phase 1 and Phase A Water Main Extension, has constructed the potable water and sewer facilities within dedicated easements to serve this development. (See attached location map). 2) Preliminary acceptance of these utility facilities was approved by the Development Review staff as follows: Madison Park Phase 1 - December 29, 2005; Madison Park Phase A Water Main Extension - September 25, 2005. At that time, the total value of these potable water and sewer utilities facilities (assets) was $119,403.22 and $260,108.59, respectively. 3) Staff recorded all preliminary acceptance documents associated with the facilities being conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney’s office as to form and legality. The County acquired its record interest by Utility Facilities Warranty Deed and Bill of Sale (“The Utility Facilities Deed”) as follows: • Phase 1 - Warranty Deed and Bill of Sale - OR Book 4027, Page 621 • Phase A Water Main Extension. - Warranty Deed and Bill of Sale OR Book 4031, Pg 1363 4) The potable water and sewer utility facilities have been operated and maintained during the req uired one (1) year warranty period, following preliminary acceptance. 5) A final inspection to discover defects in materials and workmanship has been conducted by the Development Review staff on August 19, 2014, and re-inspected on May 20, 2019, in coordination with Public Utilities and these facilities have been found to be satisfactory and acceptable. 6) Staff recommends final acceptance of the subject utility facilities as described in the Utilities Facilities Deeds. Staff also recommends acceptance of the Utilities Facilities Deeds, and the facilities described in the Certifications of Contributory Assets, which are attached to this Executive Summary. 7) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended. 8) Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water -Sewer District receiving title to the utility facilities, which at the time of preliminary acceptance, had a total gross value of $379,511.81 (no depreciation applied), and an asset will be recorded in the financial records of the county. 16.A.4 Packet Pg. 1063 06/25/2019 GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
