RESOLUTION FOR PETITION AVPLA12001-AR1835 TO OISCLAIM, RENOUNCE AND
VACATE THE COUNTY'S AND THE PUBLIC'S INTEREST IN THE IS' WIDE DRAlNAGE
EASEMENT LOCATED ALONG THE LOT l.INE COMMON TO LOTS 7 AND 8, ACCORDING TO
THE PLAT OF "MEDITERRA PARCEL Ill" AS RECORDED l;-..J PLAT BOOK 37, PAGES 8
THROUGH 9, PUBLIC RECORDS OF COLLlLR COUNTY, FLORIDA. LOCATED IN SECTION II,
TOWNSHIP 48 SOUTH, RANGE 25 EAST.
WHEREAS, pursuant to Section 177.1 () I, Florida Statutes, Barraco and Associates, Inc. as agent
for the petitioner, Long Bay Partners LLC, docs hereby request the vacation of the 15' wide Drainage
Easement along the lot line cummon to Lots 7 '1m! K, as depicted on the plat of "Mediterra Parcel Ill" as
recorded in Plat Book 37. Pages 8 through I). Public Records of Collier County, Florida, located in
Section 11, Township 48 South, Range 25 Easl: ,md
WHEREAS, the Buard has this day kid a public hearing to consider vacating said 15' wide
Drainage Easement along the lot line common to l.ots 7 and K, as more fully described below, and notice
of said public hearing to vacate was given as rcquIred by law; and
WHEREAS, the granting of the vacl1,on will not adversely affect the ownership or right of
convenient access of other property owners.
NOW, THEREFORE, BE IT RESOLVED BY TilE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that the Coullty's and the Public's interest in a Drainage Easement in
the following more particularly described lands he and is hereby disclaimed, renounced and vacated:
See Exhibit "An attach,'" hereto and incorporated herein,
BE IT FURTHER RESOLVED, thai Ihe Clerk to the Board is hereby directed to record a
certified copy of this Resolution in the Offici a I Records of Collier County, Florida, and to make proper
notation of this vacation on thc recorded plat as rei'ercnced above.
