Higgins, Inc., Bid #08- 5078 "Master Pump Station 302 Rehabilitation" for convenience. OBJECTIVE: To terminate the contract with Douglas N. Higgins, Inc. (Higgins) for convenience and rebid in accordance with the Purchasing Policy for the remainder of the project based on revised project requirements for Master Pump Station 302 rehabilitation. CONSIDERATIONS: Bids were solicited for Master Pump Station 302 (MPS 302) rehabilitation on April 25, 2008. Bids were opened on June 25, 2008, with three (3) bidders responding. Higgins was awarded the bid on October 14, 2000under agenda item lOD in the amount of$1,887,800.00. During the progression of the work, it was detennined by staff that the original MPS 302 reliable peak bypass capacity of 10,000 GPM as specified in the bid documents is not sufficient to meet current and projected capacity requirements. This scope change is necessary and, in the judgment of the Project Team, it is prudent at this time to stop all work, re-scope the project and resubmit the work for bids. "~.. Section 19.1 of the above referenced contract provides for termination for convenience with a seven (7) calendar day written notice. Staff recommends termination of the contract with Higgins for convenience so that staff can re-solicit proposals based on the revised project requirements. FISCAL IMPACT: There are sufficient funds in Projects 72548 and 72549; "Master Pump Station 302 Improvements" to cover these and any additional funds necessary to complete this task. GROWTH MANAGEMENT IMPACT: This project is consistent with and furthers the goals, objectives and policies of the Collier County Growth Management Plan to ensure the adequacy and availability 0 f viable public facilities. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office and is legally sufficient for Board action ---SRT. RECOMMENDATION: That the Board of County Commissioners terminates the current contract 08- 5078 with Douglas N.
