Agenda 09/29/2009 Item #16E 3 Agenda Item No. 16E3 September 29,2009 Page 1 of 4 EXECUTIVE SUMMARY Recommendation to approve an Amendment to Agreement for Sale and Purchase (Amendment) with Mark Bain, Esquire/Personal Representative on Behalf of the Estate of Tessie Colluccio for 1.59 acres under the Conservation Collier land Acquisition Program at no additional cost to the County. OBJECTIVE: To amend an Agreement for Sale and Purchase with Mark Bain, Esquire/Personal Representative on Behalf of the Estate of Tessie Colluccio, (Seller) to extend the time for Closing of the transaction for an additional period of ninety (90) days, up to and including October 21,2009. CONSIDERATIONS: On March 24, 2009, Agenda Item 16E2, the Board of County Commissioners (County) approved an Agreement for Sale and Purchase (Agreement) with Sellers to purchase 1.59 acres for $26,036 for Conservation Collier. Seller has initiated Probate action in order to ensure clear title, however, due to delays in the Probate process, the Seller has requested an extension of ninety (90) days to proceed to completion. The remainder of the Agreement rema,ins in full force and affect. I FISCAL IMPACT: There is no additional fiscal impact as a result of this Amendment to Agreement. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. lEGAL CONSIDERATIONS: This item is legally sufficient for Board action. This is a regular item requiring a majority vote. - JBW RECOMMENDATION: That the Board of County Commissioners approves the Amendment and authorizes the Chairman to execute same. CONSENT AGENDA \ 1 hE ADML. 91?il?OO9 Agenda Item No. 16E3 September 29, 2009 Page 4 of 4 AMENDMENT TO AGREEMENT THIS AMENDMENT is entered into this ~ day of Seotember, 2009, by and between MARK BAIN, ESQUIRE/PERSONAL REPRESENTATIVE ON BEHALF OF THE ESTATE OF TESSIE COLLUCCIO, Seller and COLLIER COUNTY, a political subdivision of the State of Florida, Buyer. auyer and Seller entered into that certain Agreement for Sale and Purchase dated effective as of March 24, 2009 (the "Agreement"). Subsequent to entering into the Agreement and pursuant to provision 3.01 of the Agreement, Buyer and Seller wish to append the Agreement with the following additional terms and conditions: 1. The time for Closing of the transaction shall be extended for an additional period of ninety (90) days. up to and including October 21,2009. Except as expressly provided herein, the Agreement between the Buyer and the Seller remains in full force and effect according to the terms and conditions contained therein, and said terms and conditions are applicable hereto except as expressly provided otherwise herein.
