EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners ("BCC") authorize the
Community Development and Environmental Services Division Administrator to
refund the Construction Inspection Fee portion in the amount of $10,867.39, of the
Review and Inspection Fees that were paid for the project known as AR 7953, Pine
Ridge Corners.
OBJECTIVE: To authorize the Community Development and Environmental Services
(CDES) Division Administrator to refund the Construction Inspection Fee for the project
known as Pine Ridge Comers in the amount of$10,867.39.
CONSIDERATIONS: Per the latest fee schedule, CDES charges a Construction Document
Review Fee of 0.75% of the probable cost of construction of the infrastructure of a project and
a Construction Inspection Fee of 2.25% of the probable cost of construction of the
infrastructure of a project as determined from an estimate of the cost of construction submitted,
signed and sealed, by the project engineer. The CDES fee schedule lists fees separately for
utility improvements and for other construction improvements specifically so that projects
outside the Collier County Water and Sewer District are not assessed a fee where the review
and inspection of the utilities is done "by others."

Due to a downturn in the local construction-related economy, some projects that had received
Site Development (SDP) or Plat (PPL) approval from CDES are not proceeding to the
construction phase. CDES has already amended the Land Development Code (LDC) to allow
for extensions of these approvals so that the project approvals do not expire as quickly as before
the downturn, but some projects are being temporarily or permanently cancelled by their
developers or their financing entities.
Per the Community Development and Environmental Services Fee Schedule as approved by the
Board by Resolution No. 2009-101, all fees, both for review and for the later construction
inspection are collected "up front" at time of application submittal The review fees collected
are expended to cover all applicable staff resources during the review phase of the project that
results in the plan approval, but the inspection fees are not actually expended and are held in
reserve until the construction portion of the project is commenced.
The developer(s) of the project known as Pine Ridge Comers, AR 7953, has cancelled this
project and in doing so has requested a refund of the Construction and Inspection Fees for the
project in the amount of 10,867.39. The limited amount of time spent on this project by CDES
field inspection staff justifies this refund amount.

LEGAL CONSIDERATIONS: This item is ready for Board consideration and approval. It is
not quasi-judicial and no ex parte disclosures are required. A majority vote of the Board is

FISCAL IMPACT: Refunds will be paid from Fund 131, Zoning, Land Use Planning and
Permitting Services, reserves.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan associated with refunding Construction Inspection fees.
RECOMMENDATION: That the Board of County Commissioners authorize the Community
Development and Environmental Services Division Administrator to refund the Construction
Inspection Fee portion of the Review and Inspection fees for the project known as Pine Ridge
Comers in the amount of $10,867,39 and to authorize any Budget Amendments necessary to
secure the requested funds from Fund 131 reserves to pay this requested refund.
