EXECUTIVE SUMMARY
Recommendation to reimburse The Villages at Emerald Lakes Four and Five
Condominium Associations, Inc., the total amount of $9,800 for the demolition and
removal of the sound barrier wall and to approve any necessary budget amendments.
OBJECTIVE: To acquire Board approval to reimburse The Villages at Emerald Lakes Four
and Five Condominium Associations, Inc. ( "Emerald Lakes "), the total amount of $9,800.00
for the demolition and removal of the sound barrier wall and to approve any necessary
budget amendments.
CONSIDERATION: Hurricane Wilma damaged the sound barrier wall adjacent to The
Villages at Emerald Lakes on Vanderbilt Beach Road. Code Enforcement cited Emerald
Lakes who in turn removed the sound barrier wall at a cost of $9,800.00. A March 4, 1998,
Easement Agreement in which Emerald Lakes conveyed a perpetual, non - exclusive easement
to the county makes the county responsible for the maintenance and repair of the sound
barrier wall (Collier County Code Case 2006040930).
FISCAL IMPACT: The $9,800.00 of reimbursement funds will be paid out of
Transportation Services Fund 101.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
-^- Attorney's Office, is not quasi- judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action. —SRT
GROWTH MANAGEMENT IMPACT: Consistent with Objectives 10 and 12 of the
Transportation Element of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners approves the
reimbursement to The Villages at Emerald Lakes Four and Five Condominium Associations,
Inc., in the amount of $9,800.00 for the demolition and removal of the sound barrier wall and
to approve any necessary budget amendments.
