Agenda 07/28/2009 Item #16A17Agenda Item No. 16A17 EXECUTIVE SUMMARY July Page e 1 1 o of f 22 Recommendation to authorize budget amendments to recognize private sector funds intended to reimburse County costs, and increase Code Enforcement operating expense allocations by an amount equal to the actual costs incurred during the successful abatement of Code violations associated with the Vita Tuscana Project, OBJECTIVE: To have the Board of County Commissioners (BCC) authorize budget amendments to recognize private sector funds intended to reimburse County costs, and increase Code Enforcement operating expense allocations by a like amount (approximately $89,000) for the costs incurred during the successful abatement of Code violations associated with the Vita Tuscana Project. CONSIDERATIONS: The Code Enforcement Department has expended approximately $89,000 in abatement costs to bring the Vita Tuscana project into Code compliance. To expedite the resolution of this issue, the Code Enforcement Department used existing operating funds for abatement related costs. Funds have now been secured from a performance bond associated with the project, and the lender for the Vita Tuscana project, Fifth Third Bank, has submitted additional funding. These funds, and these expenses, were not part of the original FY 2009 budget. By recognizing this new revenue, and increasing Code Enforcement's operating expense allocations by an amount equal to their actual abatement related costs, Code Enforcement would be reimbursed for these costs and would then be able to fully resume funding for its mission as outlined and approved in the FY 2009 budget. FISCAL IMPACT: This executive summary requires no additional tax derived funding for the Code Enforcement Department. It is a request to recognize newly received private sector funding intended to reimburse the County for the actual costs incurred during the successful abatement of Code violations associated with the Vita Tuscana Project. GROWTH MANAGEMENT IMPACT: No growth management impact will result from this action LEGAL CONSIDERATION: This item has been reviewed for legal sufficiency and there are no outstanding legal considerations. This item is not quasi- judicial and no ex parte disclosures are required. No Quote will be considered unless the Quote form is properly signed. 2. Quoters must provide unit prices any time unit prices are requested in the units requested. These unit prices must be proper and balanced so as to allow fair adjustments in quantities as required by the County. All prices will remain firm for a period of one hundred and eighty (180) calendar days from date of Quote opening. 3. Any transportation and /or any other charges incurred in delivering the product as specified must be included in the Quote price. FOB destination shall apply unless exception is made in the specifications. 4. Any discounts or terms must be shown on the Quote form. Such discounts, if any, may be considered in the award of tie Quotes. In no instance should payment terms less than fifteen (15) calendar days be offered. 5. Quoters taking exception to any part or section of these specifications shall indicate such exceptions on a separate sheet entitled "EXCEPTIONS TO SPECIFICATIONS ". Failure to indicate any exceptions shall be interpreted as the Quoters intent to fully complies with the specifications as written. Exceptions taken by the Quoter may be deemed grounds for rejection of Quote response. 6. Quoters who qualify their Quotes will be rejected. However, under no circumstances shall any part of, or pertaining directly to the Quoter's offer, be exposed on the outside of the Quote offer. Special Note: All Quotes sent by courier service must have the Quote number and title on the outside of the courier packet. 11. Collier County, Florida as a political subdivision of the State of Florida is exempt from the payment of Florida sales tax to its vendors under Chapter 212, Florida Statutes. A copy of Collier County's Certificate of Exemption ( #85- 8012621830C2) is available upon request. Corporations, individuals and other entities are impacted by Chapter 212, Florida Statutes according to the type of service, sale of commodity or other contractual agreement to be made with Collier County. By submittal of a properly executed response to a Quote from Collier County, Florida, the Quoter is acknowledging that he is aware of his statutory responsibilities for sales tax under Chapter 212, Florida Statutes. Collier County is also exempt from most Federal excise taxes. By submittal of a properly executed response to a Quote proposal from Collier County, Florida, the Quoter is acknowledging that he is aware of his responsibilities for Federal excise taxes. Contractor shall pay all sales, consumer, use and other similar taxes associated with the Work or portions thereof, which are applicable during the performance of the Work. No markup shall be applied to sales tax, 12. Tangible personal property purchased by Contractors in the performance of realty construction for the County is taxable, though the County is exempt on its own purchases. 13. In case of identical Quotes tying as low Quote, the County shall ask vendors to submit certification that they have a drug -free workplace in accordance with Section 287.087 Florida Statutes. Should all vendors provide said certification; the County will give local vendor preference. 14. Permits, Licenses, Taxes: In compliance with Section 218.80, F.S., all permits necessary for the prosecution of the Work shall be obtained by the Contractor. In addition, the Contractor shall comply with all rules, regulations and laws of Collier Agenda Item No. 16A17 July 28, 2009 Page 12 of 22 County, the State of Florida or the U.S. Government now in force or hereafter adopted. 15. When it is deemed by the County that a Quote cannot be awarded as intended, the County reserves the right to award this Quote through an approach which is the best interest of the County. 16. Alternate Quotes will not be considered unless authorized by the Request for Quotation. 17. Quoters on any construction project must be qualified and directly responsible for 30% or more of the Quote amount for said work. 18. Payment will be made by the County in accordance with the requirements of the Local Government Prompt Payment Act. Collier County, at its sole discretion, will determine the method of payment for goods and/or services as part of this agreement. Payment methods include: 1. Traditional - payment by check, wire transfer or other cash equivalent. 2. Standard — payment by purchasing card. Collier County's Purchasing Card Program is supported by standard bank credit suppliers (i.e. VISA and MasterCard), and as such, is cognizant of the Rules for VISA Merchants and MasterCard Merchant Rules. Collier County cautions Vendors to consider both methods of payment when determining pricing as no additional surcharges or fees will be considered (per Rules for VISA Merchants and MasterCard Merchant Rules). The County will entertain . quotes clearly stating pricing for standard payment methods. An additional separate discounted price for traditional payments may be. provided at the initial quote submittal if it is clearly marked as an "Additional Cash Discount." 19. Any Contractor who is a recipient of County funds, or who proposes to perform an work or furnish any goods under this Quote shall not discriminate against any worker, employee or applicant or any member of the public because of age race, color, sex, religion, national origin, disability or marital status nor otherwise commit an unfair employment practice. 20. Quoters who wish to receive copies of Quotes after the Quote opening may view and download from the Collier County Purchasing Department E- Procurement site. 21. Any actual or prospective respondent to a Request for Quote, who is aggrieved with respect to the former, shall file a written protest with the Purchasing Director rip or to the opening of the Quote or the due date for acceptance of Quotation Responses. All such protests must be filed with the Purchasing Director no later than 11:00 a.m. Agenda Item No. 16A17 July 28; 2009 Page 13 of 22 Collier County time on the advertised date for the opening of the Quote or the acceptance date for the Request for Quotations. 22. Quote award selection criteria is as follows: a. All questions on the Quote document shall be answered as to price(s), time requirements, required document submissions and electronic acknowledgment of addenda received by download. b. Award shall be based upon the responses to all questions on the Quote Response Page(s). c. Further consideration will include but not be limited to references, completeness of Quote response and past performances on other County Quotes /projects. d. Prices will be read in public exactly as input on the electronic Quote response form or written on the manually submitted Quote Response Page(s) at the time of the Quote opening; however, should an error in calculations occur whenever unit pricing and price extensions are requested, the unit price shall prevail. Mathematical miscalculations may be corrected by the County to reflect the proper answer. 23. Award of Quote shall be made in a manner consistent with the County's Purchasing Policy. 24. All firms are hereby placed on NOTICE that the County Commission does not wish to be lobbied... either individually or collectively ... about a project for which a firm has submitted a proposal. Firms and their agents are not to contact members of the County Commission for such purposes as meetings of introduction, luncheons, dinners, etc. During the Quoting process, from Quote opening to final Board approval, no firm or their agent shall contact any other employee of Collier County with the exception of the Purchasing Director. 25. The Contractor shall employ people to work at County facilities who are neat, clean, well - groomed and courteous. 26. If the Quoter should be of the opinion that the meaning of any part of the Quoting Document is doubtful, obscure or contains errors or omissions he should report such opinion to the Purchasing Director before the Quote opening date. 27. The County assumes no responsibility for Quote responses received after the due date and time, or at any office or location other than that specified herein, whether due to mail delays, courier mistakes, mishandling, inclement weather or any other reason. Late proposals shall be returned unopened, and shall not be considered for award. Agenda Item No. 16A17 .July 28, 2009 Page 14 of 22 28 Quoter acknowledges, and without exception or stipulation, any firm(s) receiving an award shall be fully responsible for complying with the provisions of the Immigration Reform and Control Act of 1986 as located at 8 U.S.C. 1324, et seq. and regulations relating thereto, as either may be amended. Failure by the awarded firm(s) to comply with the laws referenced herein shall constitute a breach of the award agreement and the County shall have the discretion to unilaterally terminate said agreement immediately Agenda Item No. 16A17 July 28, 2069 Page 15 of 22 Scope of Work Collier County will not provide any construction materials or allocate public resources for the construction of this project. Location The project is located on Treeline Drive off Immokalee Road and Olde Cypress Blvd. within the Olde Cypress Community in the Vita Tuscana Site. A mandatory on site meeting will be conducted on Monday, March 3, 2009 at 9:00 am. Description of Work: This site entails of 28.6 acres of cleared land that had house pads built up and ponds at beginning staging of excavating for development. The site has to be brought back to its original grade and conditions to meet code. The house pads must be leveled down to existing grade. The existing rocks on site can be used to fill in ponds. There are stock piles of debris that were originally there to protect preserve area during construction that must now be leveled and distributed throughout the site. Last phase of the project is to hydro seed with Bahia and two inches of top soil may be needed in order for the hydro- seeding to take. The hydro- seeding must be watered in order for it to grow. The project consists of: • Grading existing house pads to level with existing grade and leveling all stock pile material and distributing it throughout the site • Backfilling the existing ditches or ponds with existing materials on site • Adding 2" of top soil throughout the entire site • Hydro - seeding entire site and watering adequately in order for hydro - seeding to take • Constructing a silt fence the length of the project as per plans while work is being performed. • Alt: Street Cleaning may be needed since there is only one entrance into site which is a main entrance into another community. • Towards the back of the site there is an existing preserve area which must be protected and can not be disturbed. • Within the adjacent site there is an existing landscape buffer which should be kept away from. If any damage is incurred it will be the awarded contractors responsibility to fix or replace to its original conditions. General Conditions All work must be completed by April 1, 2009. It shall be the Contractor's responsibility to notify in writing the Project Manager of any construction problems or additional construction needs or any change in key personnel. Agenda Item No. 16A17 July 28, 2009 Page 16 of 22 Should additional costs be involved which are not covered within the Contract Specifications, a Unit Cost shall be agreed upon, a Change Order to the Work Order completed by the Contractor and Project Manager prior to performing additional services. The Contractor shall communicate frequently with the Project Manager and provide a working schedule after the "Notice to Proceed" has been issued. The written schedule is required to be kept current with the progress of the work. Should the schedule be changed, it shall be immediately up- dated. During the Contract the Contractor shall be required to hold weekly progress meetings unless otherwise specified by the Project Manager. The Contractor is responsible to attend other special meetings that the Project Manager should require. On a twenty -four (24) hour basis, the Contractor may be required to travel to the site immediately to meet with the Project Manager, law enforcement or emergency personnel to resolve an emergency. The Contractor shall respond to a telephone, beeper, or radio call within one (1) hour. There shall be no additional charge for these responses. The disposal of all debris and construction litter must be at a proper landfill or disposal site. All disposal fees, tipping or charges are to be included in the Quote Schedule -" Price, if necessary. This Project will require a Performance and /or Payment Bond if lowest responsive and responsible quoted price is over $200,000, and it shall be submitted prior to commencement. Costs for the Bond and other insurances are incidental to this Project. Pricing Use the Quote Schedule, a separate file download for completion and uploaded as denoted on the e- procurement system. Clarification was requested on grading existing house pads to level with existing grade • The house pads must be leveled off and graded. 2. Clarification on Street Cleaning: • Street Cleaning is defined as utilizing a street sweeper to clean any additional dust /dirt that this project might bring into the main entry road (Tree Line Drive) 3. Request was made to add a spreadsheet for pricing: A bid tab will be added to e- procurement which has to be submitted by contractor with pricing in order to be considered. 4. Specification called for adding 2" of top soil: The contractors were instructed to price this as alternate in case it is needed before hydro - seeding. 5. Change: The project timeline has changed • After the approval of the work by CEB on March 26, 2008 the Notice to Proceed will follow. • Work must commence shortly after the Notice to Proceed is issued. Within a four week timeline all work with the exception of the hydro - seeding must be completed. • In the rainy season hydro- seeding will commence, scheduled date approximately around June 15, 2009. 6.
