Agenda 06/23/2009 Item #16F 5 Agenda Item No. 16F5 June 23, 2009 Page 1 of 7 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners approve a budget amendment in the amount of $483,773, and approve payment for detention services provided by the Florida Department of Juvenile Justice (DJJ). OBJECTIVE: To obtain Board approval for a budget amendment in the amount of $483,773 and to reimburse DJJ for those detention services for the remainder of FY 2009. CONSIDERATIONS: In the fourth quarter of FY 2005, the county began to pay for costs of pre- dispositional days associated with the housing and feeding of juveniles being held in state-run Department of Juvenile Justice Detention Centers. Pre-dispositional days are days that the juveniles spend in the detention centers before appearing before a judge. Following those appearances, the State of Florida is responsible for detention and any associated costs. Previously all costs were paid for by the State of Florida. The following is a breakdown of budget versus actual costs since inception. --- Collier County DJJ Budget vs. Actuals Year Budget Actual FY 2005 $ 861,244.00 $ 312,634.68 FY 2006 $ 2,000,000.00 $ 1,367,595.41 FY 2007 $ 2,000,000.00 $ 1,549,838.43 FY 2008 $ 2,000,000.00 $ 1,518,214.73 FY 2009 $ 2,000,000.00 $ 2,483,772.64 Proj ected Collier County has had an original budget of $2,000,000 since it began budgeting for these costs. The reasoning for this was to cover all anticipated and any unanticipated costs during the fiscal year. Until this year, the county has always budgeted sufficiently to cover DJJ costs. Last week, DJJ conducted two teleconference sessions to explain the variances that numerous counties are experiencing. TIrree staff from the Clerk of Courts Office (Crystal Kinzel, Derek Johnssen, & Nancy Fragione) and one from the Office of Management and Budget (Randy Greenwald) participated in the June 10tll session. After hearing the explanation on how their budget was formulated, all came to the same conclusion that we are liable for the invoices that will be associated with this fiscal year. - Attachment I to the Executive Summary depicts how DJJ apportions its budget to each of the 67 counties in the State of Florida. DJJ uses the latest audited actual information to estimate pre-dispositional days for each county and this information is factored against the total State DJJ budget of $99,431,539 to arrive Agenda Item No. 16F5 June 23, 2009 Page 2 of 7 at a proportionate share for each County. For FY 2009, the estimated pre-dispositional days were equal to the actual days from the State Fiscal Year 2007/2008 spent by Collier County juveniles in the detention centers prior to an appearance before a judge and the state taking over the responsibility and costs for those juveniles. The original estimate for Collier County was 8,157 pre-dispositional days out of a total of 572,155 for all counties (1.42%). In January, DJJ issued an adjustment based on audited pre- dispositional days. The Collier County share changed significantly because of the under-estimate of the County's pre-dispositional days and the over-estimate of the total days for all counties. The new audited total of 1,149 additional days increases the total to 9,306 Collier County pre-dispositional days. Further skewing the estimate was an over-estimate of 153,283 days from the original 572,177 days for an adjusted all county total of 418,872 pre-dispositional days. This resulted in Collier County having a 2.22% share of the budget instead of 1.42%, which equated to an increase of$668,466.63. At the beginning of June, Collier County received another adjustment that was the result of the audited conditional release update. This increase totaled $99,208.48. Along with these adjustments, the State increased the monthly billings from $128,954.61 to $183,816.61, an increase of $164,585.10 for the final three months of FY 2009 (Attachment 2). This occurs every year due to different starts of the State's and the County's fiscal years, although the change hasn't been as significant over the most recent years. In FY 2006 the total 3 month increase was $56,507.22, in FY 2007 it was a $36,806.25 decrease and in FY 2008 it was a $26,519.70 increase. FISCAL IMPACT: A Budget Amendment from the General Fund (001) in the amount of $483,773 is needed to reimburse outstanding and future FY 2009 billings for detention services provided by the Florida Department of Juvenile Justice. GROWTH MANAGEMENT IMP ACT: None RECOMMENDAIONS: That the Board of County Commissioners approve increased payments to the Department of Juvenile Justice and approve the necessary budget amendment in the amount of $483,773 to cover those costs.
