EXECUTIVE SUMMARY
Recommendation to Award Bid #09-5237, Underground Storage Fuel Tanks - Removal
and Replacement, to Surge Solutions Group, Inc., in the amount of $447,884.00, authorize
the Chairman to sign the contract, and to approve the necessary Budget Amendments.
OBJECTIVE: To obtain approval for the award of a $447,884.00 contract to Surge Solutions Group, Inc.
for the removal of several underground fuel tanks located at the Government Center, the Immokalee Jail
site, the Port of the Islands Marina, and replacing four of the five non-compliant tanks with new
underground tanks meeting the Federal, State, and local regulations that are effective December 31,
2009.
CONSIDERATIONS: Pursuant to Florida Administrative Code, Chapter 62-761, effective December 31,
2009, all storage tank systems in the state must adhere to the requirements for secondary containment.
Florida Department of Environmental Protection (FDEP) has stated that they intend to strictly enforce
those requirements and will be issuing violations and fines for failure to comply. Collier County has five
(5) existing underground tanks (including the one at the Port of the Islands Marina) that do not meet the
new regulations. One of the five tanks will be removed and not replaced by re-routing the supply piping of
the equipment served to another existing tank. The other four tanks, however, must be removed and
replaced along with the associated underground piping. The Department of Facilities Management
retained HSA Engineers to formulate a plan for compliance and to prepare a bid package to make the
necessary removals and replacements to bring the County into compliance by the December 31, 2009
deadline.
On April 20, 2009 Collier County Purchasing posted the solicitation for bids to remove and replace the
existing, non-compliant tanks.
Electronic notifications were sent to seven hundred and fifty four (754) registered firms with ninety one
(91) firms downloading the bid document. A non-mandatory pre-bid conference was held for overview
and clarification of the bid package, in which fourteen (14) firms participated. On the due date, May 20,
price submittals were received from seven (7) firms with Surge Solutions Group, Inc. being the lowest
responsive and responsible bidder meeting the specifications. A copy of Purchasing's bid comparison
spreadsheet is attached.
FISCAL IMPACT: The cost for this recommended award was anticipated and sufficient funds were
budgeted for Government Center tanks and the Immokolee tank in fund 301, Project 52525 and Project
53172. The cost for the tank at the Port of the Islands Marina was also anticipated as part of the
purchase agreement, however, a Budget Amendment is required to shift $140,000 from Project # 80083,
Sable Palm Lake Lining, fund 306; to Project #80086, Port of the Islands, fund 306 for the Parks and
Recreation tank at Port of the Isles.
LEGAL CONSIDERATIONS: This item is not quasi-judicial and as such ex parte disclosure is not
required. This item requires majority vote only. This item is legally sufficient for Board action. - CMG
GROWTH MANAGEMENT IMPACT: There is no impact on the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners approves the award of Bid #09-5237 in
the amount of $447,884.00 to Surge Solutions Group, Inc. for the removal and replacement of several
underground fuel tanks located at the Government Center, the Immokalee Jail, and the Port of the Island
Marina, authorizes the Chairman to sign the contract, and approves the necessary Budget Amendments.
