EXECUTIVE SUMMARY
Recommendation to terminate the contract awarded to Amera- Tech, Inc., for Bid #09-5194
"Collier County Right-of-Way (ROW) and Median Mowing and Maintenance Annual
Contract" in the amount of $43,000.00
OBJECTIVE: To obtain the Board's approval to terminate the contract awarded under Bid
#09-5194 to Amera-Tech, Inc. on March 24, 2009, Item 16B6 by the Board of County
Commissioners for the maintenance of Vanderbilt Beach Road (Airport Road to Collier Blvd.)
and Rattlesnake-Hammock Road (Polly Ave. to CR951), for convenience, as allowable under the
contract.
CONSIDERATIONS: On February 6, 2009, bids were solicited for Bid #09-5194 "Collier
County Right-of-Way (ROW) and Median Mowing and Maintenance Annual Contract." On
February 19, 2009, bids were opened, and on March 24,2009, the BCC approved three vendors
to maintain seven different segments. The County awarded Amera-Tech, Inc. the Vanderbilt
Beach Road (Airport Road to Collier Blvd.) segment at an annual cost of $33,850.00 and
Rattlesnake-Hammock Road (Polly Ave. to CR 951) segment at an annual cost of$9,150.00.
An official Notice to Proceed was provided to Am era- Tech, Inc. for the maintenance of the two
awarded roadways. Staff met with Am era- Tech, Inc. before commencement of the work to
_. review areas. On May 13, 2009, staff received an e-mail from Amera- Tech, Inc. stating that they
no longer wished to perform this work and requested termination of the contract.
The County is exercising the option under contract, Section 8, Tern1ination, to terminate for
convenience. The maintenance work originally awarded to Amera- Tech, Inc. for Rattlesnake-
Hammock Road (Polly Ave to CR 951) will go to the next vendor on Bid #09-5194, Vila and
Son, Corp. in the estimated annual amount of $ 18,032.00. The other segment Vanderbilt Beach
Road (Airport Road to Collier Blvd.) will be contracted out by other means of procurement.
FISCAL IMPACT: Budget is available in Fund Ill, Cost Center #163811 and 163846 for the
continuation of maintenance under a new vendor.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action.-SRT
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
RECOMMENDATION: That the Board of County Commissioners terminates Contract #09-
5194 awarded to Amera- Tech, Inc., for convenience, as allowed under the contract and re-
awards the maintenance work for Rattlesnake-Hammock Road (Polly Ave to CR951 to Vila and
Son, Corp. whom is also an awardee under the contract.
